Buying a New Car: Your Rights

After a house, a new car is often the largest purchase you will make. Given the sums involved, it pays to know where you stand legally before you sign anything, and what your options are if something goes wrong after you drive off the forecourt.

Before you buy

A reputable dealer is the best starting point. Word of mouth from family and friends is useful, and most established dealers belong to a trade body such as the National Franchised Dealers Association or the Retail Motor Industry Federation (the Scottish Motor Trade Association covers Scotland). Membership usually means the dealer signs up to a code of practice and an independent dispute resolution scheme, which can be helpful if a problem arises later.

Price is usually negotiable. Manufacturers publish list prices, but dealers often have room to move on the on the road figure, particularly at the end of a quarter or when a new model year is approaching. Whether you pay in cash, finance through the dealer or use your own funds, it is worth pricing each route separately. Part exchange is convenient, but selling your old car privately may raise more. Take your time, get quotes in writing and compare.

When you reach the paperwork, check that the figure you are signing for is the full on the road price. That usually includes VAT, vehicle first registration fee, number plates, road tax for the first year and delivery. Anything described as optional, such as paint protection or extended warranties, should be itemised and priced separately. If a salesperson makes a verbal promise about specification, delivery dates or extras, ask for it to be written into the order form. Promises that are not on the contract can be difficult to enforce later.

Deposits and cancellation

Most dealers will ask for a deposit when you place the order. Make sure the order form sets out what happens to that deposit if you change your mind, if the car is not delivered on time, or if the agreed specification is not available. Some deposits are refundable in particular circumstances and others are not, so it is worth reading the small print carefully before handing over money.

If you bought entirely at a distance, for example fully online or over the phone without visiting the showroom, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 usually give you a short cancellation window. The same applies to some off-premises sales, such as a deal concluded at your home. Cancellation rights do not normally apply to a purchase agreed face to face on the dealer's premises, even if you only signed the order an hour ago. Citizens Advice has up to date guidance on how the rules apply in particular situations.

Your rights under the Consumer Rights Act 2015

The Consumer Rights Act 2015 is the main piece of legislation covering goods bought by consumers from traders. It replaced earlier statutes such as the Sale of Goods Act 1979. Under the Act, a new car should be:

  • of satisfactory quality, taking into account the price and description;
  • fit for any particular purpose you made known to the dealer, for example towing a caravan of a stated weight;
  • as described, including any specification, mileage, colour or trim level set out in the brochure or order form.

If the car fails to meet these standards, you have remedies against the dealer who sold it to you, not the manufacturer. The manufacturer's warranty is a separate, additional protection. Your rights then depend largely on how long you have owned the car:

  • Within the first 30 days, you usually have a short term right to reject a faulty car and get a full refund.
  • After 30 days, but generally within the first six months, you can normally ask for a repair or replacement. If the repair does not resolve the fault, or if it would be disproportionate, you may be entitled to reject the car or to a price reduction.
  • During the first six months, a fault is generally presumed to have been present at the point of sale unless the dealer can show otherwise.

Paying for the car

How you pay affects what protection you have if things go wrong.

  • Credit card: Section 75 of the Consumer Credit Act 1974 makes the card provider jointly liable with the dealer for breaches of contract or misrepresentation, on transactions where the cash price of the item is over £100 and not more than £30,000. Even paying just the deposit on a credit card can be enough to bring the whole purchase within Section 75, although this is fact specific.
  • Debit card or other payments not covered by Section 75: you may be able to ask your bank for a chargeback under Visa or Mastercard scheme rules. Chargeback is not a legal right, but it is often a practical route to a refund. Time limits apply.
  • Dealer finance, such as hire purchase or personal contract purchase: the finance company is the legal owner of the car until the agreement is settled, and is also the party you complain to about faults, because in law you bought the car from them. They are responsible under the Consumer Rights Act in the same way as a cash seller would be.

If something goes wrong

On collection, check the car carefully before you sign for it. Look for paint defects, panel gaps, scratches and missing accessories. Make sure the V5C registration document, service book, handbook and any spare keys are present, and that the mileage on the odometer matches what was agreed. Note any concerns on the delivery paperwork before you drive away. It is easier to sort issues out at handover than weeks later.

If a problem does emerge, put your complaint to the dealer in writing, keep copies of all correspondence and give them a reasonable opportunity to put things right. If you cannot reach an agreement, check whether the dealer belongs to an alternative dispute resolution scheme such as The Motor Ombudsman. Trading Standards, accessed through Citizens Advice, can also help. As a last resort, the small claims track of the County Court handles many consumer motor disputes.

@Woody Hi Woody, no, you shouldn't have to pay extra. The dealer can't unilaterally change the terms of your agreed contract, so if they can no longer supply the colour you ordered at the price you agreed, that's their problem to sort out. Ask them to honour the original price on whichever alternative colour you pick, or offer a full refund of your deposit with no penalty. Get any agreement in writing before you sign anything new.

I agreed to purchase a new car from a Toyota dealer in September with a delivery date in December, today, November 11 I have been informed that the colour I have chosen is no longer available, if I chose another colour that has a premium price will I be expected to pay extra because I do not like the other colours on offer.

Hi,
I took delivery of a new Audi Q8 e-tron 250KW 50 Quattro 95kwh Sport 5 door in October 2023. On 5 November 2023 with 350 miles on the clock, the car broke down. It was taken away on a tow truck by the AA to Audi for repair.

The car was fully repaired by Audi under warranty and returned to me 9 weeks and 4 days later on 11 January 2024.

Whilst my car was in for repair, I was given an Audi A1 courtesy car.

The car is leased at a cost of around £800 per month via a work salary sacrifice scheme.

Have I any rights to any full or partial refund given the substantial difference in cost of car between an Audi Q8 and an Audi A1?

If you return one of two items to a supplier with their nominated and arranged courier and it is completely broken in transit and cannot be repaired - are they still responsible to replace/refund the item if they say you returned the wrong item and they didn't authorize it?

Bought a new Mazda 6 soul Red crystal matallic on 13th september 2019
10 days after taking delivery i noticed paint chips. complained to dealer and he advised me to take to a mazda paint specialist for examination. due to family commitments and the now covid 19 I wasn't able to do this until july 2020 by this time the chips have increased by man. the mazda paint speialists took photos and made out a report and sent to mazda. This was 2 months ago and still no word on repair. who is responsible mazda or the car retailer

I've bought a brand new Hyundai 130n only had it three months it was sold with a after market full body kit on it when purchased. Travelling at speed last week the front piece broke off and went under the car upon pulling over to inspect the car the whole front has been pulled off and only the screw holes remained. Luckily no other damage was done to the car or myself or any other drivers. They are now saying we have to pay for the part and they will fit it free. Not happy at all. Can anyone help with this matter or advise me please. Thanks Steve.

I purchased a brand new vauxhall Astra Sri end of March 2020 only 7 miles on clock now it’s back at the dealers to get a brand new engine fitted said the turbo is faulty it has done less than 1000 mls am I entitled to ask for replacement they can’t give me a date when it can be repaired

I bought a Nissan Leaf (electric) but the battery is not working the dealer has been fixing it for over 3 months already and they gave us another car but we have to put gas and it is costing us more. Can we terminate de car lease agreement?

Hi,

I've just brought a new Qashqai on a 3 year lease, there seems to be a technical fault with it as it's costing me a fortune in fuel. the mpg's is nowhere near what was described to me on the leasing website. I have to take the car to a Nissan garage this week, however how can i cancel the lease agreement without forking out on fees? i've only had the car for a month and i'm already having to take it to the garage??

Brought a new van from Cornwall taken back to Kent.
A fault has come up they can’t fix straight away.
Iv ask the garage we’re I brought it from to come collect and sort out they won’t collect it. Saying get AA to do it but the AA will only take to neaserst garage.
Can I insist the salers collect it ?

I have purchased a Mercedes A180 from jct600 and drove away on a 7 day insurance. I tried to insure the new car but was unable too as the car has been registered as an automatic and not a manual. 6 weeks later I still don't have my car however have been given a car to use. My first payment has come out of my account for a car I've not had any advice on this and my legal standings much appreciated.

I purchased a brand new BMW M4 CS from a local dealership. I paid an external company to ceramic coat the car in the showroom. They found damage to the front bumper, rear bumper: a chip to the drivers door and swirls all over the car. The dealer is saying they can use a local company to repair the damage but I’m worried about their ability to match the 3 pack pearlescent paint. Can I legally force the dealer to replace the vehicle with another one that’s exactly the same and that hasn’t been treated so badly and damaged. For a £95k car, I don’t want it to have been resprayed as I intend keeping this car in perfect condition. Thank you.

I’ve just found out that my jaguar is being recalled as the published emissions are significantly higher that advertised in real world tests.

I find it completely unacceptable that JLR have allowed this to happen, particularly following the Vw saga.

The car is less than a year old and is on a personal lease.

My last car was a vw with the emissions cheat software!

JLR have offered to rectify the issue but this misses the point that I have been driving it for a year spewing out an unquantified amount of co2 etc.

I would like to understand if they have breached the lease agreement and what my rights might be regarding early termination without penalty.

Hi I bought a New car from BMW £65k, On arrival of picking the car up the sales person dint show me round the car and also seemed in a rush to get rid of me. On first glance the car looked OK but was in a shady area.

When i arrived home the same day i noticed a few scratches and some panels and also some dint's on the drivers door, i notified the dealer straight away they have advised that i had ample time to look over the car and therefore they will not do anything about it. As a new car worth over 65k i have asked to return the vehicle which they are refusing to do, do i have the right to ask them to take the car back ? and if so under what act or cooling of period?

I purchased a new car 68 plate earlier this month collecting this on the 9th October from a franchise dealer. I got a great deal through the manufactures own scrappage scheme so making the purchase less than if I had paid cash only or part ex'd. On collecting the car and driving off the forecourt I had a warning on the dash that some of the safety systems were disabled due to a fault with the front facing camera. I contacted the dealership advising them of the issue and they recommended that I take the car home (as they were closing) and return the car to them later. I called in at the dealership on the following Sunday, the 14th, for investigation. Whilst there they started the car and immediately a warning appeared advising that there was an 'emissions failure' and the MIL light illuminated. They took the car out and couldn't get it to go above about 20mph. My car was left with them and I left in a courtesy car. I received a call on the 17th advising that the emissions problem was fixed but they were waiting for a replacement front facing camera. I arranged therefore to collect the car on the afternoon of the 19th allowing them to perform the repair correctly. On the morning that I was due to collect I received a call from the service manager advising that the 'emissions failure' fault had returned. Their head office advised them to replace a number of parts however availability of some of the parts is unknown and will take a minimum of a week to arrive maybe longer (I am awaiting their update). They have had the car for over a week and I expect that it will take them at least another week to complete the repair. Am I within my rights to reject the car under my 'short term rights' and would I receive anything for the scrapped car that formed part of the discount or only the invoiced value, noting that should I wish to go elsewhere I now have nothing to scrap or trade in.

I bought a brand new Nissan in March 2017. Jan 2018 I took it back to the dealership as the floors were soaking wet. The inside was taken apart, a hole was found in the wheel arch, the car was dried out and put back together again. At the time I complained directly to nissan and they did not seem interested but gave me an extra years warranty to get me to go away. I wasn’t happy with this but I was getting no where. Oct 2018, the floor is soaking again. Car taken back to the dealership and it has had to be sent off to the bodyshop to see why it is leaking again. I have told the dealership I do not want the car back. I paid a lot of money for a brand new car and it has leaked twice! Do I have any rights to ask for a refund or a new car?

We'd advise contacting a solicitor to deal with this. If they date of the accident was definitely before you took delivery of the vehicle, the dealer or the transportation company will know about it. A responsible dealer will investigate this on your behalf, they have, after all, sold you a vehicle that is not in a condition you would have expected from a new car. So:
(1) Go back to the dealer, ask them for details of the company that delivered the vehicle.
(2) Respond to the solicitor and MIB and let them know that you actually took delivery of the vehicle the day after the accident, give them details of the dealer from whom you purchased the vehicle
(3) Talk to Mercedes Financial Services and tell them you want to return the vehicle on the basis that it is faulty/not as described
(4) Ask a solicitor for advice on what you can do in terms of compensation etc

I purchased a new Mercedes taking delivery in March 2018. The car was delivered to my home address, I was shown round the car, from the visual walk around all seemed well (but i did not get down on the floor and inspect the underside of the car) I signed the delivered note.

Now 4 months later i received a letter from a solicitor seeking insurance details for the vehicle, as its was involved in an accident the day prior to the cars delivery to me. After seeking details of the accident, I have inspected the underside of the car in the area of the suggested impact and find evidence of damage on the underside of the rear of the car consistent with the alleged accident.

I am less them impressed that I am now fielding solicitors letters and letters from the Motor Insurers Bureau seeking to identify the driver and insurers at the time of the accident. More importantly I am concerned that I have been delivered a brand new £50k car that has been damaged.

The dealership claims not to have been made aware of any accident, as they use a 3rd party delivery agent and have not been advised of an incident. The car is on a PCP deal with Mercedes Financial Service.

I feel conned that I have been delivered a brand new luxury car, that has been damaged and they only way I find this out is through a solicitors letter seeking to claim for damaged / injuries to a 3rd party.

What are my option, can I reject / return the car?

On Friday (today is Sunday) I purchased a brand new car from a large dealership. I put my existing car in part exchange. I drove the car the three miles home from the dealership, the clock now has seven miles on it. Other than driving it home I didn't have the time to familiarise myself with everything the day before yesterday, so yesterday I sat in the car on the drive and started the engine. The service light was on permanently and a message saying 'engine fault have vehicle repaired' appeared on the screen. I rang the dealer this morning and they are sending someone to collect it for repair tomorrow morning (Monday).

I have spoken to a couple of friends today who are of the view that I shouldn't even go there but should return the car and ask for my money back as it is likely that it always have problems. I purchased the car with a part exchange (my previous car was in excellent condition with less than 4,000 miles on the clock), now thinking I have made a big mistake. Can you please advise how I stand legally in view of the part-exchange. Many thanks.

The retailer is not obliged to take the car back in these circumstances. It might be easier to sell it as part of your father in law's estate.

My father-in-law purchased a new car recently, he paid a deposit plus had a £2,000 scrappage exchange and paid the remainder in full which was almost £11,000. The car was delivered to his home whilst he was on holiday, but unfortunately he passed away before coming home. The car is obviously not needed, or fit for the purpose it was purchased for and yet the dealership have not offered to take it back, but have offered only £8,000 ti buy it back. What are our rights?

Hi, I bought a brand new car in January 2018 for just under £70k.
After a week of ownership I noticed paint flaking from the N/S side skirt where the panel meets the rear wing. It was sent back to the dealership bodyshop for repair. They resprayed a small area so that the whole side of the car didn't need respraying. Needless to say it is fairly noticeable if you were looking for it but "was the best they could do without repainting the whole side of the car".
Having hardly used the car (just over 1000 miles in 5 months) I just recently noticed in the sun that the N/S/R wing has marks in the base coat of the paint as if it was painted with a large brush! I took the car back to the dealer bodyshop and they did a paint thickness test on the whole car. It seems that my brand new car was repainted on theN/S rear wing and N/S door before delivery. He said that the whole side of the car needs to be painted now due to the paint type.
Added to that the stereo/sat nav unit has an intermittent fault where it keeps shutting down for 5 mins then restarting on its own!
Do you think I'm entitled to a refund?

I've now had enough and am within my 6 months for rejection.

Hi I filled the paper work for new car through Toyota and they said they will give me the special no plate which next day they just sent a e mail saying this no plate is allocated . I have signed the orde form and finance agreement and have not picked the car yet . Now I called them that I do not want to go ahead with this after 5 days of agreement . But dealer is saying that I am legally bound to go ahead with this . I do not know where I stand .

If you think you were misled by the saleperson, you might be able to claim compensation or a partial refund. As it's over 12 months since you bought the vehicle and you've had use of the vehicle for that period it's very unlikely you will get a full refund etc. Write the dealer and explain what you told the saleperson about your requirements and the problem that is now present - then say that you think the person who sold you the vehicle misled you and that you feel you should be entitled to a partial refund under the Consumer Protection from Unfair Trading Regulations 2008. You may need to seek advice from a legal professional or Citizens' Advice to help with this. Bear in mind that there is always an element of Caveat Emptor (buyer beware) when making a purchase, so you are expected to have done sufficient research of your own etc

I bought a new Honda CRV in Jan 2017. During my discussions with the Honda Salesman I made it clear that I was retired, 90% of my driving was in town and that I drove less than 5000 miles a year.
I bought a diesel engined vehicle in the belief that it was more efficient and cost less in road tax.
I now have Diesel Particulate Filter problems which persist despite repeated "corrective" actions by the garage.
I would like to know what my consumer protection rights are inas much that I should have been sold a petrol car rather than diesel because of my driving profile.

Hi, I bought a car from Mercedes Benz new via PCP on 19/12/2015. Since then it has been into the dealership for repairs many times, repairs include exterior lighting faults and rattles. The one rattle has been there from day one and has claimed to of been fixed many times. It's now louder so pursued harder for it to actually be rectified instead of just telling me it was when it wasn't. After many more trips back and forth to the dealers after they said it was repaired again and again but wasn't, they realised I am not giving up. They've suggested they can't solve it after many attempts and have seemed assistance from a body specialist. I've lost faith in the car and believe the quality to be extremely low for the brand. I've put in for rejection to the finance company. My question is because the fault has been present since day one, but given the amount of chances the dealer has had to repair, am I still in my legal rights to reject? Thank you

You may need to negotiate a fee with the dealer if the problem is a result of the product you had fitted post-purchase (and we assume was not fitted by the dealer).

After more than 3 years, this is something you'd have to negotiate directly with the dealer, or failing that the courts. At this stage it's not a straightforward consumer rights issue that we can give direct answer to.

My 2017 RS focus is 8 month old, had a slight tap from engine. So returned it to dealer , been with there 4 weeks, eventually they found the problem, on taking the sump off the engine they found a piece of piston, (told the skirt of the piston blaming my aftermarket cat back exhaust. And back pressure change) I am getting an engineers report done but now my engine is in bits, do I now owe the dealer for work they have done so far? And I drove the car to the dealer, can I request them to put it back how I left it with them so I can drive it home? Or to another garage for repair?

Hello. I bought a car from a dealership in 2014 (it was a year old) and have always been happy with it. However, it always seemed damp during rainy weather and after a heavy downpour whilst travelling long distances, the car was filled with water on the passenger side, both front and back, if I placed my hand on the floor, it was completely covered with water. I have just taken it back to the dealership's repair shop, as rust was spotted on the door too and to see what was causing the problem. They have informed me that the near side back door is not the original panel, it wasn't fitted correctly and that it is faulty, which is why water has been coming into the car. I was never informed of this at purchase and they have evidence on their records showing this to be true. They've accepted responsibility and are drying my car out and repairing the damage. However, what if there is damage to the interior of the car, particularly the floor, caused as a result of the water, now or in the near future. Are they responsible for sorting that out too at their cost? I'm worried that further work is going to be needed.

Hi. Bought a new car. Car went in 2 weeks later to dealer for an upgrade. Whilst at the dealer it got covered in a paint spray. The dealer sent the car for a detail.. then when collecting the car the retailers had scratched the car and also caused swirls to the paint.
What are my rights. The car is less than 4 wks old. Can i return the car. Or swap the car.

It's unlikely you'll be able to take the car back for a full refund. If it's over 6 months since purchase, it's up to the buyer to prove the fault was there at the time of purchase etc. Please see the article above for more information on what steps to take next.

I picked up my new 17 reg car up in May 2017.....After contacting the Dealer in November I was told "not sure who to speak to".... so finally when I spoke to the Manager and complained I was being put through different departments the car went back to the dealer in December ... the roof was corrected over a period of two days and claimed off the warranty. The dealer insisted that I picked the car up on the second day later that afternoon. I told the dealer that I would pick the car up the following morning as I would not be able to inspect the work carried out on the car. I got told no as they needed the courtesy car back that afternoon.
Picked car up that afternoon... all seemed o.k when I checked that morning.... however I have now picked up another part were the paint on the roof is coming away ... I really would now like to take back the car and get a refund...

Hi I have owned a brand new Range Rover evoque since march 2016. So far it has had to have a turbo replaced, a complete new exhaust system, a new differential, a new cat system. It has had multiple call outs for Land Rover assist in addition.
What is my option as I am fed up of having to return the car for repairs, missing meetings and rearranging my schedules?

I have placed an order for a new car ( shipping from Germany) on the basis of a delivery by end of November - this is stated on the Deposit Receipt, but is the only place written confirmation is detailed .
I have completed a New Vehicle Order form and this has been countersigned.
I have email correspondance signifying the car is late and this has not been disputed.
I have now been told the car is delayed and there is no estimate as to when the car will arrive.

What are my rights if I choose to cancel ?

Hi I’am looking for advice/help. We purchased a Landrover Discovery Landmark Sdv6 A. Date of reg 09/2016. Landrover Dealer Stratstone in Cardiff.
In May 2017 Coolant pipe split & it got fixed on our drive by the Landrover assist, then on 15th June 2017 vehicle caution light came on and went into limp mode (restricted performance) vehicle had to be recovered & went back to dealer vehicle got fixed “well that what we thought”.
Then the following date’s all relate to (Restricted performance) it got taken back & fore from Stratstone and again & again went into Limp Mode, Car was and still is dangerous to drive when going into Limp Mode.....
Then back in on the
19th June 2017, 22nd June 2017, 28th June 2017, July 2017, 27th August 2017, 3rd September 2017, 15th September 2017, 4th November 2017.
Then last of all the vehicle was making a noise like and old tractor/bag of spanner’s and i opened the bonnet & oil was splattered over the engine coming out of manifold, we contacted landrover assist again he came out and inspected vehicle on our drive i started vehicle & he immediately told me to turn off as it was an awful noise so it went in again and still 2 weeks later no vehicle, we received 2 phone calls saying the still trying to solve the problem & still got Curtisey vehicle. (WE HAVE HAD A CURTISEY CAR MORE THAN WE HAVE HAD OURS) we been to finance as part cash part finance & they say as they still fixing vehicle we can’t return, we also been to the ombudsman and because i took vehicle out on my business name not my own name I have no consumer rights?????

You could try asking for compensation for the delay. An accidentally broken and replaced windscreen is probably not sufficient grounds for rejecting the vehicle under the Consumer Rights Act.

You could ask the dealer to keep the car until January. The registration plate will still say 67 - but the documentaion will say first registered 1st Jan 2018, date of manufacture Dec 2017. It's up to you really.

Hi, I placed a car on order at the end of October 2017 and the dealership told me it would be the end of January/ start of February 2018 before the car would arrive which means it would be 2018 when registered. But now on the tracking it explains build of the car will commence at the start of December 2017, if the car arrives before the 1st of January 2018 does it have to be registered straight away or have i the rights to argue it doesn’t be registered till 2018 as they have to register it with my personalised plate also. My mum bought a pre-registered brand new Toyota in August. The dealer told her they had mislaid the documentation relating to registering the car but would look for it, register the car in my mum's name and she would receive the registration document in the post. After 3 months of waiting and numerous calls and emails, it transpires they had registered the car to someone else who had a pulled out of the sale then sold it to my mum.They have said the have repeatedly asked the first keeper to return the documents but she hasn't done so. They dealership are now denying a pre-registered brand new car means registered to the dealer but can be registered to anyone. They have been very unhelpful. How do we proceed?

I brought a brand new Range Rover Evoque in November 2016 - within the first 30 days it had to go back due to a park brake fault, I was told it had been fixed and then within another 30 days it has been back again for the same fault of which I was told it was fixed. Over the following months up until now it has been back to Range Rover (2 different dealers) 6 times and is now required to go back for a 7th as has a park brake fault again!
I keep getting fobed off with "it's fixed" and "just a software update required" this is clearly not the case as in 11 months it has been in the garage 7 times!
The vehicle is on a PCP can I reject this vehicle or request Range Rover provide me with a new vehicle that is not faulty?

Within the first 30 days you can reject the vehicle but the dealer does not have to give you back your PX vehicle. They must refund the amount they took for it in the part exchange deal.

Car all paid for no finance. Pulled away from dealers for a light to come up on dash and car lost power (went into limp mode) took it back straight away, they changed a valve and sent me away again. Yep light came back on took it back again. Sent me away in a lone car told me techs will look at it on Monday. My question is, if I traded in a car, can I get a full refund and my old car back. Do they own the car I traded in and can not give it back to me with full refund as the car they sold me was not fit for purpose.

Becauser the vehicle has already been back to dealer for over a month of the 6 month period, we think you should follow the guide above and treat it as though it is still within the 6 month period i.e. You should allow the dealer a chance to repair the vehicle, "if the retailer can't repair the car, or have tried to repair it and the fault still exists, you will be entitled to return the product and receive a refund. However a reasonable deduction may be made by the retailer to reflect your use of the vehicle in the preceding months."

We've had our Evoque from new it's now 6 months old. It has broken down on me for the 2nd time this time the alternator has "gone". Fumes had been in the car from 2 weeks ago at which point I took into the dealership to be told it was a burn off smell typical of all new cars well that same smell then resulted in the car breaking down in a car park with white smoke coming out of the vents on the bonnet. The first breakdown resulted in the power steering failing whilst I was driving thankfully I managed to pull over into a lay by and the car wouldn't re start. The dealership had the car after the first breakdown for 5 weeks before the fault was discovered to be a wiring problem?
So my question is I am over my 6 months since purchase ( just) but they had it in their garage for over 1 of those months an I still within my rights to reject the vehicle as I do not feel safe in it with the two major faults which are not related that have happened in such a short space of time.

If the car is unusable/has not been used since your first complaint, then yes you can reject the vehicle on the basis that you've waited too long for the problem to be resolved.

Bought a brand new car from dealer in Sheffield (Carwow) using the manufacturer fincance (PCP). I waas told by the dealer and sales literature it has "AGILITY CONTROL suspension with selective damping" & the dealer said I could do the "selecting" of suspension stiffness (a real selling point).
Picked up on 09/08/17 - Found a fault with stereo on the drive home as it just stops making any noises. Also discovered faulty carpet fitting and the remote boot just opened on its own at random. I also could not 'select' the suspension settings.
Got a call from customer services (11/08) & I told them, they relayed to the original dealer who arranged my local dealer (Preston) to fix it on (24/08).
Carpet was sorted but they couldn't find a fault with anything more & told me the suspension was adaptive but I couldn't select anything myself.
It's an automatic & I have since had the "hill assist" system fail twice (so I roll backwards on hills!) and there is a rattle in the exhaust.
I spoke to the manufacturer on 08/09 & told them of all the faults - they said they'd try and sort it out. I then e-mailed the dealership on 11/09 and the manufacturer on 12/09 advising I want to reject the vehicle.
Since I had to wait two weeks for the initial attempt at a repair am I still within my rights to say they had their chance & they have to take it back?

A month ago, I agreed a price for a new car, shook hands on the deal and paid a deposit. The car agreed on was standing in the showroom and was to be collected on date of new registrations,
The dealer has now told me that I can't have that specific car unless I pay extra for a Protection Pack, which that vehicle has, and if I did'nt pay this they will order me another car which will take another month before delivery,
I have said that the agreement was for me to buy that specific car (which they said would be taken out of the showroom and prepared for me) and I was not paying anything extra and could'nt wait another month as I have to return my daughters car which I have been borrowing.
What are my rights in this matter?

I bought a brand new Hyundai i20 at the end of September last year. It had a fault with power the day after purchase. It took weeks for them to admit the issue and finally admitted a problem with the injector, which was replaced and car drove ok until now. Now have same issue and garage haven't bothered to look at it yet in 3 days. I have no confidence now in this car. It is still less than a year old, would I have any rights to a refund/replacement? After 4 months you should still be entitled to a repair or replacement (the dealer can choose). Please see the above article for more information. If the dealer says nothing is wrong (have they actually driven it?), you may have to get an independent inspection carried out.

I have had a new MG3 for 4 months. It constantly stalls and the steering is now jamming whilst turning. The breaks are also very hard. I have taken it back to the dealer who says there was nothing wrong when they ran it through the computer. However, the courtesy car, exactly the same model, drives like a dream. There is a vast difference. I am very dissatisfied. Where do I stand? Can I get a replacement?

I bought a brand new car - made the mistake of collecting from dealer when it was raining. The car had 5miles on the clock. Next morning in the dry daylight there was an obvious scratch across the drivers door and less obvious scratches on every panel - returned it straight to the dealer. More damaged was caused to the door trying to get the scratch out so the dealers suggestion was to take a door off another new car?! Surely this now devalues two cars! Can dealers simply swap and change doors on new vehicles?! And as a consumer how would you know if this has happened prior to your purchase of a 'new' car?

You do need to talk to the delaer who will want to assess the problems you've had (rather than just take your word for it). Tell the dealer that you want to exercise your 30 day right to reject. Basically after that you are effectively rejecting the car back to the finance company and they will need to work with the dealer to refund them their money. The finance company should return your deposit and any payments already made.

Took delivery of new car from main dealership on Monday. Car financed through manufacturers own finance company with dealer as agent . 3 separate faults in first 3 days- window jammed half open within hours of delivery ( damaged mechanism due to loosened bolt ) ; failure to start ( due to poorly connected sensor ) ; and juddering windscreen wipers failing to clear rain from windscreen ( incorrectly fitted wipers ) . Other faults appearing on a daily basis , although minor . I believe car can be rejected and refund requested . That will leave me with no car and no cash to fund other purchase . I understand the finance company is the legal owner of the car - they say talk to the dealer . The manufacturer says talk to their finance company . Who is the first entity to talk to and what is the right process ?

Was it a new vehicle? If so you can probably still take action under the new car warranty if nothing else. Was the vehicle serviced at any point in the interim? The service provider may be culpable if so. Either way, go back to the dealer and start asking questions straight away.

Most garages will take a look at something for no (or low) cost. Tell him to take it to another garage to see if the problem can be diagnosed. If turns out to be something under warranty he can take it back to the dealer he purchased from, or an alternative Suzuki dealer. Note that you can have your car serviced outside of the dealer network without losing your warranty. If you are on a lease plan this doesn't necessarily apply.

I helped purchase a brand new Suzuki swift for my sons 21st ,it's only turned 1year old days ago and not long had a service it's covered by 3 year manufacturers warranty.Its developed a very load squeal and I spoke to the garage that's attached firstly I'm told their might be an £85 labour cost added and my son has just delivered the car to be told theirs a £90 diagnostic fee at no time or in any place shown is there saying that the warranty comes with extra costs im feeling ripped off considering my own 1.5 year old car just went in another garage and nothing extra and offered tea and a paper is this garage yanking my chain.

How long have you had the vehicle? If you've only recently collected it then you should give them a few days to give a date for installation of the heated seats. If they cannot do this then you can reject it within 30 days of purchase on the basis that it is "not as described"

Hi I have the same issue as an other owner above. I collected my new focus St line silver on the 3/5/17 but x2 days later when washed. Patchy paint work is was present on the roof & spoiler along with stone chips- debris in most panels under the base coat and laquar.
God knows how this car passed its pre delivery inspection!!!! There's no way Im going to accept the car to be resprayed. Like for like replacement must be the only way forward surly? Can I just return the car and give them the keys. But what happens with my old car which I part ex? :(

Is this a coded key? If so getting one cut or replaced could be expensive and you should negotiate with the dealer over whether they pay, you pay or they share the cost (depending on what discounts you already have etc).

I purchased a Brand New 17 plate Focus ST3 Estate 3 weeks ago.
I've noticed after a detailed polish the following;
Drivers door has Laquer Bubbles
Passenger door has dust particles exposed through the paint
Rear Bumper is scuffing on closing
Took it to my local Ford dealership (didn't purchase from them), but advised by the dealership I did to take it there....
Anyway; they've told me all 3 above need a full respray....
Spoke to Ford I purchased from only to be told it's under warranty, so it'll be rectified....I DONT WANT MY NEW CAR RESPRAYED !!!!!

Obviously I'm not happy about this as it's a brand new car with less than 400miles on the clock.....

I bought a used car in January 2017. After signing all necessary documents including HP paperwork, I was handed only one key.

When I asked the dealership where the second key was, it was then I was told there was only one key, after all I knew the car was used.

The fact that there was no spare key was not stated in the sale advert.

Who's responsibility is it to get the spare keys, me or the dealership?

Hi I have just bought an audi A6 it is a 66 plate. From the first couple of weeks I have found 4 different paint issues. Audi have rectified these problems in a fasion. I have found another defect, audi have my car now and they say it has gone to Audi body shop Birmingham were it can be tested and put write. I have sent numerous e mail's to Audi Wolverhampton but they don't seem to bother replying. No you're not entitled to your old vehicle back. Your consumer rights say that you will be entitled to the full invoice price of the car you purchased. If you want to claim extra for the money you have spent etc, you will have to make a separate, private claim via the small claims court.

There is a certain amount that the buyer should make themselves aware of when the car is purchased. Usually, you have a look around and check the paintwork etc before you buy it. You may find it difficult to return it on the basis of some obvious scratches that were there at the time of purchase.

Purchased a car on finance two days ago. Third party fixed a scratch on wing, now it doesn't match the colour of the car. Arnold Clark advised they would fix it. Since that, I've noticed bald tyres, the manager agreed to fix one. I have a baby, and don't want to think there could be more wrong with the car. The dealer should repair this under the terms of the Consumer Rights Act 2015 as detailed in the above article. Contact your finance company first of all. If they cannot arrange to get the work completed, then you should write to the dealer informing them of the legislation and say that you will consider legal action.

I've recently picked up a brand new car on a 3 year personal lease deal, the car has lots of scratches over the entire car, looks like someone has taken a rag over the paintwork when it's been dusty. The dealership has been a complete nightmare to deal with, after about 3 weeks of arguing about the paint work they have agreed to pay for a 3rd party to polish the scratches out of the paintwork. Can I refuse this, and ask for a replacement car? Two different car paint specialists have said that for a new car the paintwork is an absolute disgrace, I have a meeting next week with the dealership and would like to know what rights I have.

Hi, Bought a new 17 plate car, agreed 3 yr service plan was right for me, this is shown along with the amount I paid on my invoice. This was delivered over 2 weeks ago.
Dealer now informs me I cannot have a 3yr service plan as not available (I got a 0% finance PCP) and all I can have is 2 year or 4 year - both of which are not as good value as far as I can see - do I have any rights? can I insist they honour what is on my invoice/what was ordered and agreed? all signed for. Purchased a 2017 barbarian last Saturday brand new - after signing all paperwork and paying were shown the vehicle which had a mark on rear tail gate. Salesman said no problem would be sorted under warranty , this dealership is 2 hours drive from home - we have asked for local Mitsubishi approved body shop but been told it needs to go back and that they will pick it up and return it !!! ( excessive mileage)
Today we have notivved two further goughes in the boot lid (fibreglass) which have been badly coloured in and MUST have been seen to have been 'repaired' prior to pdi .
Can we insist on local approved body shop so we can ensure repair done correctly or do we have to go to the body shop they state
Don't feel we can trust them - it's brand new - not second hand

While you can reject a car within 30 days if it has a fault that was present.To reject it, the fault should be significant enough to prevent the car from doing its job properly. Small cosmetic issues or minor faults which can be easily repaired are not usually sufficient grounds under which to reject a car.

Hello, please can you help?

Myself and my wife ordered a brand new car which we are due to collect in the next few days.

We are part exchanging two cars, both of which have current finance and both of which have a little negative equity. The dealer sorted that and rolled it into the new monthly payment.

However, since agreeing the deal three weeks ago our settlements on our current cars have gone down by a combined figure of £523. I believe that this should be reflected in a reduction in the new monthly payment however the dealer says no.

They say that they will simply reduce the price of our part exchanges to reflect the new settlements.

Is this fair? Should we not see some benefit of the lower settlements?

Hi, I went to pick up my new 17 plate Q7 and after all the excitement I noticed a dent on the door and paint was chipped on it, so I told the sale rep and got his managers and they all reassured me that it would be repair to Audi standards and will not affect the paintwork warranty etc..
I told them that's I was happy with it as iv paid 65k for it and don't won't repair done on a brand new car, it should be a new car not repaired new. It seems like it's a defect from the manufacturer.
Now I don't feel like I want the car anymore as I'm not happy with it plus many other mistakes the dealers made with the payment where they tried to over charge me by 2k which was resolved and they admitted it was their fault. They said today that Audi should compensate for the defect from the total balance but I'm not sure what to do or how much shall I ask to be discounted for this issue and if the door should be replaced with a new door rather than getting it repaired.
Any advise would be much appreciated.

I signed to buy a new 66 plate on 6th February. Ford Focus Titanium. This has still not been delivered to dealer on 14th March. They have a back log of deliveries. I think this is unacceptable as the new 17 Reg has now been out for 2 weeks. If the car arrives can I ask for a reduction in price as it is no longer a new Registration or can I ask for a 17 Reg?
The dealer sent me the V5 and registered the car to me in February but still no delivery. Thank you for any advice on my rights.

I bought a new mini clubman. The boot has a concealed well and after 5 months I could smell damp in the car. On lifting the concealed lid I noticed mould and water in the well of the boot. I took the car in for repair at 5 months. Two weeks later the car was returned and after a period of rain I noticed the leak was still there. I returned the car again and after 2 weeks had the car returned and again after a period of rain noticed the leak was still there.
I returned the car for a third time indicating that if it was not repaired I would seek a refund as the car was not fir for purpose, I put this in writing. I took the vehicle back in for repair and after 2 weeks the car was returned and again the car leaked after rain. I rang the dealer and asked for a refund, they indicated that my statutory rights would not be affected but I would have to return the vehicle to ascertain who was at fault. Two weeks later they returned the vehicle and indicated that the fault had been repaired. I told them that I wished for a refund or vehicle exchange, I am still waiting for a reply. Do you have any advice?

I purchased a ford transit brand new from a main dealership, it's now 21 months old and has been in and out of 2 main dealers workshops with persistent warranty work, mainly the hill start feature, after 8-10 visits they eventually found the problem (well part of the. Problem) and I has now gone back in again and they have found another fault, I can help thinking I have been sold a lemon, and the main agent has pretty much said that they can't help me further? What can I do?

Hi, I ordered a new Ford Fiesta ST Line in Nov 16. I was aware there was a new model in process so I asked for that model. I phoned the dealer twice and confirmed that I would be receiving the new 2017 model. I have just been told this model hasn't even been released yet?? I also received another call to say my car is on it's way. So in short can I reject the car because it's not the car I thought I ordered?

I ordered a new car and this was to be delivered on 23rd Feb 2017. Dealer advised me that they cannot deliver as the car has a fault which needs to be rectified before the handover, manufacturer's requirement. I insisted for further explanation and was told that the repair concerns fuel lines and these need to be ordered from Germany, therefore a delay of some 1-2weeks. Do I have the right to cancel the order ? Bearing in mind that this is a brand new car, do I have to accept what I view a repaired vehicle, further the fuel lines are safety critical items.
Your view would be much appreciated.

Bought a brand new Fiat 500 that was in the showroom on 18/2/2017 for delivery on 1/3/2017 with £500.00 deposit, to find out today that the dealer had already sold the car to someone else!
They have offered new a same spec car currently being factory built to be delivered by "end of March".......and we will put in more fuel than we usually would! I did point out that £30 compensation was not good enough.
When I asked for the factory option that I didn't get with the car I ordered Saturday, apparently too late to put that option on the car!
I just said I would think about my options and go in tomorrow to discuss further.

Yesterday 19/02/2017 my partner and I went to our local Volkswagen garage to discuss trading in our car for an upgrade.

We found the car for us and paid a deposit of £500 and have paperwork for a new vehicle order. The dealer was to contact us today 20/02/2017 to discuss delivery date for the purposes of our insurance.

Today they called to say they have sold the car to another individual, therefore the car is no longer available to us to purchase. They offered us an alternative in a colour that we did not want and a diesel which we also advised this was the reason we were upgrading as we preferred the petrol car.

Can you advise if they can do this as we have in good faith paid the £500 and signed the vehicle order.

This depends whether the malfunction light is actually indicating a fault. Within the 30 day period, it is possible to return an item that is genuinely faulty.

I have bought a Vauxhall Astra 2years and 5 months old on the 7th Feb 2017, a fault showed up 3 days later on Malfunction indicator light , the garage has had the car for the last 9 days and have took it to Vauxhalls twice , first they said it was the blue tooth parrot, came back with the same fault , went back into vauxhall, now they say it was damp around the ecu . and should be fine now ,
if the malfunction light comes back on can i get a refund from the retailer

I had a Peugeot 208 Style 14 plate (on finance). The same garage I bought this from offered me a Peugeot 208 Active 66 plate for just slightly more a month (on finance). When agreeing to the sale we asked if the new car was the same spec as my current car, the sales exec told me it was exactly the same just brand new and that the "style" had stopped being made and the "active" was the "NEW" style. We asked to test drive an car that would be exactly the same and they gave us a car to test drive. We agreed to go ahead with the sale. When arriving to collect my new car, it was clear that it was not the same spec as my previous car not the same spec as the car we test drove. We we're rushed away after the purchase earlier today and we are wondering where we stand? Thanks.

Good day I recently purchased new a Hyhundai sportage everything was perfect about a month ago I noticed th strangest thing happening on the pumper I saw a black spot out the corner of my eye that's not suppose to be there so I have a closer look , the pair peeled straight off the plastic bumper exposing the raw plastic how is this even possible and I demanded a new number so I took it in and they said they would replace , prior to that I had my doubts of the dealer of course so I marked the bumper were I would know where to look and see if they replaced it or put a new one on and the car came back and true as my gut was right they sprayed the bumper and found my mark I left in the bumper is this legal if I asked for a replacement bumper after a factory default had accused am I not entitled to it as part of the consumer protection ? Please advise asap

I Purchased an A45 AMG from Lister Mercedes.
It was ordered in October and I picked it up 22 December 2016.
It did not have the correct spec that I had ordered. It has been purchased on their own finance plan. The dealer said they would order me a replacement with the correct spec and that would arrive March time and that I could keep the car that was wrong until then.I agreed to this and am paying the payments for this car.
It has now come to light that the car will not be here until April which means it will fall into the new road tax laws that come into effect on the 1st April 2017, because of this it will now cost me £310 more a year for 5 years for road tax then it will go back down to £140 a year.
If the car I had originally ordered and picked up in December had been correctly built I would only be paying £140 a year road tax. Is there anything I can do about this? Am I within my rights to ask the dealer to meet this cost ?

I ordered a new car on 6/11/16. I was told there was one available and we were looking at picking it up on 21/11/16. The date arrived but no call from the dealers I rang and asked for an update. I was told that the car had just arrived in the country and was at Dagenham, it would probably arrive within the next week. the car has still not arrived to date. The car has been registered as I received the log book on 23/11/16. Can you advise me of my rights of cancelling the car as we are now coming up to it being 1 month old and the payment due to come out in December.

No you can't specify a replacement but a dealer could offer you one if they think this is a better option than a repair. You are entitled to a repair or replacement within the first 6 months (but the dealer can choose which option to offer you).

I bought a brand new Kia Sportage about 4 month ago about 6 weeks ago I had smoke and a strong burning smell coming into the car between the dashboard and windscreen took it to dealership said it was the ecu on the car said they replaced it but then it happened yesterday same place on dashboard and smell I am really worried in case whatever is burning makes the car go on fire can I ask for the car to be returned n Kia supply me a new one there is only 1100 miles on the car.

We have just got a new grand c max, when ordering my wife asked that it gave front and rear parking sensors, when collecting we asked the sales person were the sensors at the front fitted and she indicated that she believed that they were. We have since found that the car does not have factory fitted front sensors, the company trustford have said that we signed the paperwork at the time, as agreeing to the car , where do we stand under the law

I placed an order by telephone from Cyprus to a UK Ford dealer and gave him my debit card details over the phone for a car. An amount of 500GBP was deducted. This was Feb 2016 and the lead time for the car was quoted as March 2017. I have not been into the dealer and I have not signed an order either via email or on their premises. I do however have an order confirmation that was posted to me in the UK from them. The enclosed order and copy has been signed by the salesman, but not me. I was told via email that I did not need to return the signed order. In addition to this I received an order confirmation but no actual build date. My situation has changed sadly and I won't be in a financial position to take the car in March 2017. I have informed the salesman who informs me my deposit is not refundable. I believe it is as it will not be difficult for them to sell and indeed the car has not yet been built or delivered. Can you kindly advise.

I got a car on finance on Tuesday 8th November, noticed Sunday 13th November that it had had a replacement of a panel above passenger wheel and paint work done to a poor standard on places so I took to the dealer and spoke to manager and he is giving me a signed letter to say all that was there when I bought it (so it doesn't come back on me in 4 years when I hand it back). Anyway on Tuesday the 15th I was under the bonnet to fit my black box and noticed a large L crack on the engine floor at the passenger side (which is where a panel has been replaced) and also noticed on the bumper at the passenger side just where the wheel is there is the inside of it with some missing and it's wobbly as I can wiggle it up and down wjrh one hand without much strength. Where do I stand as to should they fix it? As I'm booked in with them and hopefully they'll agree to sort it free of charge because I haven't done anything to the car and wouldn't expect to check those things as its my first car. I feel they've taken advantage because I'm young and knew I wouldn't look in those places and I've signed for the car but I wasn't told about any of this on the car but they do "supposedly" check before they sell the cars

As it's still within 6 mothns since you bought it, the follow applies:
"If the retailer can't repair the car, or have tried to repair it and the fault still exists, you will be entitled to return the product and receive a refund. However a reasonable deduction may be made by the retailer to reflect your use of the vehicle in the preceding months." Demand a refund as you've been put to quite a lot of inconvenience while the repairs have been attempted.

I bought a new Porsche Macan in June 2016, by mid-September the navigation and phone functions had stopped working and it seems as if there is a problem with the software. They won't tell me when they can fix it (they say they are waiting for an SD card from Germany), meanwhile I have been stuck with the car which does not meet the spec for the past 2 months. I can't get any answer from them, their service has been terrible (not what you expect with their brand) and I think they have gone beyond a reasonable period to remedy the problem. Any advice for what I can do at this point? Thank-you

I bought a new corsa last October and we have had a faulty stereo since purchase. I was unaware of my rights to return and have since let the dealership attempt to fix it on a total of 10 occasions with no joy. The manufacturer have sent people out who again can't fix it. I sent a letter of rejection because I have had enough of the attitude of the dealer alongside the failure to fix the problem only to be told that the car rejection is not accepted by vauxhall head office because it still starts and drives. Im left shocked and at my wits end as to what to do now. I told the salesman at the time that the car was purchased that because it had full Bluetooth capabilites we would make the sale. The main reason for buying the car is the main function it doesn't perform yet I'm left paying full price for a car with only 50% of the catalogues functions

If you've been provided with a courtesy car and your car is fixed to satisfactory standards, it will be difficult to ask for a refund at this stage. If the repair is not successful you might be offered a replacement.

We purchased a new Discovery Sport HSE Luxury for circa £45k using LR Finance. After collecting the car at the end of May within the first 1-2 weeks we noticed fume smells in the car and returned it to a LR dealer. They claimed to have identified a loose connection and returned the car to us. In July/August we noticed the smell had come back but was intermittent so the car was returned to another dealer in Devon (we live in Kent) as we were visiting family at the time. This was returned to us again about a week later. On the 7th October we returned the car for a 3rd time to the dealer we purchased the car from with the following items to be corrected; 1) Fume smell, 2) Gearbox problem, car shuts down periodically and message regarding selecting another gear appears, 3) Sat Nav crashes regularly, 4) Phone calls can't always be taken via the car's system, 5) Only 3 or 4 DAB radio stations are available, 6) Windscreen fogs regularly, 7) Repeated tyre deflation warning, 8) Auto dimming lights have never worked and 9) Parking sensors go off for no reason (this happened when the car was last taken back and the dealer witnessed this.

As we purchased the car using LR Finance we have notified them, the dealer has had the vehicle now for 2 weeks and claims to have rectified the issues and will be testing the car over the next 2-3 days before handing it back to us.

We have just about had enough but want to be sure where we stand, we have had the car now for nearly 6 months although about 1 month of that it has been back with various dealers and so are unsure whether we should accept the car back (my wife has lost all faith in it) or whether we are within our rights to return it.

LR Finance advise that since we contacted them they have begun a process of liaising with the dealer (which they say can take up to 56 days) and should we have any further problems we must advise them and they will determine whether we can return the car or not.

At this stage I'd rather we didn't have the car back and we were returned to the financial situation we were in before we took delivery of the car but feel that as the dealer has tried to fix the problem (albeit the 3rd dealer to do so) we are duty bound to accept the car back.

I purchased a Range Rover Evoque last month. After driving away I noted that the rear view camera wasn't on the car as part of the expected spec. I notified the dealer immediately and on checks, yes a rear view camera should be on the car. They would contact Land Rover and it would be fixed. Happy Days! Today I have been told they can't retro fit but have offered compensation. However I would much prefer the spec that I originally purchased. Where do I stand please? Thanks!

I have bought a brand new ranger, signed the paperwork and when getting in to take home noticed a dent. It looks like it had the dent before it was sprayed. Then we found the stitching in the seat had come loose. I have it on finance with the garage and have paid a subsantial deposit and now monthly payments with a balloon payment at the end. I feel like I am not getting the new truck I agreed to. The garage we picked it up from documented the damage so there is no question it occurred before it came to our possession. Can I reject the truck and expect a full refund even though we signed the handover document?

I bought my car in May 2016 for 39000 , I reported a rattle from the b pillar 4 days outside the 30 day period of rejection.
The defect has been known at JLR for two years, they have a highly invasive fix for this problem that involves removing the roof liner m the windscreen the seats , carrying out structural welding to the b pillars. The fix to date has a 2% fix rate according to forums on this vehicle . The forum suggests 33% of vehicles are affected .

The technical bulletin from JLR states the vin range for this defect is open ended.
This means new cars may also have this defect.
I have been offered a replacement vehicle, with assistance from JLR inputting 4,500. But I would rather have my money back as it is very possible the new vehicle will have the same defect. JLR will not tell me that this defect is fixed.

Dealer says its new vehicle , or he will only give me a trade price refund of 30k.
My car has only covered 400 miles I haven't used it since this all began 3 months ago.
I cannot find what a "reasonable deduction" is for my vehicle surely it not his lowest trade price?
He is after all selling same car on his forecourt for 36,000.
I cannot afford to throw money away I am a pensioner! What do I do?
Accept a new car which may have a structural safety defect or just accept I have lost thousands.

This depends on whether having the wrong registration number has adversely affected you. For example, has your real number been used by someone else? Have they committed any motoring offences etc? Can this be rectified on your vehicle registration history without affecting the re-sale value etc? You need to work out whether you have/will have suffered any financial losses because of this and then decide on whether you think it's worth claiming compensation.

We bought a brand new kia sorrento in February 2015. Today I had a problem with the bonnet so called rac out. They told me my number plate was for a vw lupo8and that I had to prove the car was mine. While I was with the rac I phoned kia and after some investigation it turns out kia fitted the wrong plates when we bought it. Are we entitled to any compensation because of their error.

You have no rights to return the car on the basis that you didn't research it sufficiently prior to purchase. If the car becomes faulty within 30 or from 30 days - 6 months you have the remedies described in the above article.

It's not normal to receive your deposit back unless a car is actually faulty etc. If a salesman told you that you could have your deposit returned however, you should follow that up with the dealer and the salesperson in question.

Went to trustford in erdington birmingham .
Chose a car and applied for finance in my moms name .
The finance went through but at a much higher rate .
After a week and half thinking this through with family .
I took the decision not to go through with it .
I asked for the 300 pound deposit and they said because they took the car off sale they won't give back the deposit ..

They said it's been going for at two weeks but they knew we was trying to get the right finance deal for me ..

But now they are refusing to give back deposit .

There is no where on the forms saying it's non- refundable
And the salesman said at the time we can have our deposit back .

The deposit was paid by my wife

Any help please where I can go to resolve this matter ?

Bought a brand new Mitsubishi Barbarian from a dealer in 2013 and is just outside its 3 year warranty. In the last week the head gasket has gone and they are asking for £2,000 to fix it. What are my rights under the consumer act as surely this is not deemed wear and tear on a 3 year old vehicle !!

I bought a brand new Audi a1 on the PCP scheme in 2013 which allowed for part exchange anytime during the 4 year deal. I deposited £2500 for this car at the time and was told at the end of the scheme I would get that back atleast. During this time the emission scandal came out and unfortunately my car was one involved. Audi (or VW) are yet to recall my vehicle despite confirming via letter that it would be at some point. For over a year Audi have been contacting me to part exchange sooner, however, I haven't been interested until now, which only 8 months left on my scheme. Today on discussions they informed me that based on what I still owe the car has no equity value, so I've essentially lost that £2500 and probably then some. On private sale the car continues to be worth £2k more than they are suggesting, however, my question is regarding the emission issue. It seems my car is devalued due to this, however, so far Audi (or VW) have made no attempts at compensating me, infact I now know I've essentially lost out significantly. When I asked about the emission stuff the salesman said "oh let's not go there; it's a sore subject". I feel they are trying to duck giving me what im owed as I was essentially conned into thinking the car was more valueble than reality. It seems this de-value in equity is actually more likes to be what it will cost them to sort the emissions. Am I wrong to feel suspicious and is there anything I can do about this? Thanks

I bought a truck on evening of July 28th 2016. On July 29th I headed out on my vacation 5 hours from home. I got half way and the truck was having multiple issues. Not starting and engine when slipping I could not go past 45mph up hills with out it losing power and going in and out. I pulled over and immediately called the dealer. They said to finish trip and bring it back as there was nothing they could do until Monday August 1st. I had to leave my trailer and quads at my destination I took it into a dealership at destination they couldn't find the problem and said they could check it out the following week. I took truck back to dealership I bought it from and they said they would fix it. I waited and heard nothing back from them a week later, I called and told them I did not want the truck. The following week they said they were fixing it
Still nothing this went on every couple of days and now 31 days later I still do not have truck and they won't let me out of the deal. I have spoken to the finance company who loaned me the money they say that only the car lot can get me out of the deal. I'm so done the car lot said that they want me to drive it whenever it gets fixed and they have no idea when that will be before they will allow me to get out of the deal. A sales associate told me that the owner has no intention of unwinding the deal. It's been 31 days since I have had truck in m y possession and I'm so exhausted with this ordeal. I want out and don't know what else to do. My first payment is due and the dealer wants the 2nd part of down payment. I already gave him 2000. Down now he wants the other 2000. I still have no truck and car insurance is due. What are my options? Please help this is so wrong. Communication has been limited as owner avoids MD I feel like he is waiting for time to go by.

I bought a Ford Fiesta second hand from a Trustford dealer in Belfast. When washing my car I noticed some paint peeled off on the roof of my car. As soon as I noticed it I rang the dealer. This was 1 calendar day after I purchased the car 6 months ago. The dealer is saying even though it is a second hand car and months after purchasing that it was not there when I bought it. They are blaming it on bird poop which was left on my car. I have had ford cars for twenty years and never had a problem with paint work and look after my cars very well. If it was bird poop then this would have caused damage to the paint on other parts of the car but couldn't have as I always clean it off when it rarely happens at the time. I took it to an independent car bodywork specialist who told me it was not bird poop and looked like a defect. I bought the car part Hp through fords. Looks like the dealer is not going to fix this for me for free. Is there anything I can do. Also who do I complain to next. I have an email chain re the complaint and logged calls with them. Hope you can help! Thank you

I bought a Honda CR-V. I have in writting and it was agreeded that Sirius Satilite would be paided for for 3mo. After getting home we realized it did not have it in the system . They hard wired a portable one by the drink holders. All they are offering is to pay for a year of SS or trade car in and pay more for a upgraded CRV. I can't see the device when driving and if a drink spills it coukd ruin it. What can I do??? Pkz help.

Part exchanged a mini cooper for a Mitsubishi ASX in April 2016 from a dealer over an hours drive away. The ASX has now developed a strange ticking noise on acceleration. Am I within my rights to ask the dealer to repair the fault and if so can I ask that it is repaired at a Mitsubishi dealership 2 miles from my home or do I need to return it to the dealership I bought it from?... I picked up my new Mercedes GLE up last October and within a matter of a week i have been having problems. These arrange from carpet has gaps so can see underneath, the trim off the back falling off (second time now), centre armrest had to be replaced as got worse as weeks went on (couldn't open it), glass case wouldn't open due to dropping something dropping inside.. thats just a few faults what have occurred over the recent months. I am into double figures now with all te problems. It just seems like a 55k car has been thrown together. To be honest i dont drive the car much now as i am waiting to take it in for more repair work as worried more things will go wrong.. Where do i stand on replacement or what can i do about it?

You unused road tax will be refunded. It's unlikely you'll get the cost of the new car registration back under the Consumer Rights Act as this covers the admin required to register the vehicle by the DVLA.

Unfortunately not all dealers hold stock of every car part, as it's not practical. If the car was faulty, the dealer would probably provide you with a courtesy car, however as you've been in an accident, you should arrange this with your insurer.

I rejected a new car within 30 days, and received a refund, BUT it was less the cost of the New Car Registration Fee and the road fund licence. I will receive a partial refund from the DVLA, but what about the rest? Presumably DVLA will not refund the New Car Registration Fee?

I ordered a brand new factory built Range Rover Vogue from a reputable dealership. Two day before collecting my car, they called me and said they noticed a wind noise coming from the sun roof during a test drive. They needed to investigate further. They gave me a demon car to drive for the time being. It's now been almost three weeks now. I was told the car has been sent to Range Rover specialist to be fixed. I feel really uncomfortable with this. If I have to spend almost £90,000 for a new car, I would expect everything to be perfect from factory. If the car is now being taken apart, I really don't feel it's really worth the price. I have only paid the dealer £1000 deposit. What would be my options? I don't really want the car now that it's been taken apart. Can I get my deposit and walk away? If not, can I insist on them ordering a brand new car from Range Rover? Thank you Raymond

If the dealer has promised to rectify this (and this is not an uncommon situation for new cars), then there's not much else you can expect. Most dealers will - out of goodwill - add in some extras, like a spare set of mats or a free valet in the next few months.

You do have to give one opportunity to repair the car - if the fault still exists, you will be entitled to return the product and receive a refund. In your case, you might be able to claim some compensation for the incovenience you've experienced, particularly in having your holiday ruined.

I purchased a Volvo XC60 3 months ago. Whilst towing our caravan in the South of France the auto transmission failed and as we were on a motorway we had to call the French Police and get towed off. We contacted Volvo assist and spent over an hour on hold before we managed to speak to someone. They arranged for the car and caravan to be towed a further 80 kms. The caravan to a caravan site and the Volvo to the local dealer. They arranged a hire car for us.
Four days later we called into to dealer to collect some items from the car and were shown an e-mail from Volvo Assist telling them not to touch the car as it was being sent to Spain for the work to be done. Obviously we were not happy with this and after spending 2 hours at the dealership Volvo Assist gave the French garage the go ahead. Two days later we were told the car had to go back to the UK and our local dealer would do the work. They could not supply as with a towcar and we ended up having to accept that they would repatriate both the car and caravan back to the UK. Two days later and 400 kms toward the ferry Volvo Assist rang us to say that now the French garage were doing the work. If they had only told us this before we left we would have waited ! We carried onto the port and are now waiting for word of when we will see both car and caravan. Totally ruined our holiday and have no faith in Volvo or Volvo assist. We have even cancelled our October booking with Brittany Ferries to Spain because of all this upset. Would we be able to get a full refund on the Volvo ?

A re-spray should probably be acceptable for the purposed of the consumer rights legislation. As for a courtesy car, there is nothing specific about this in the legislation, you should raise it with the garage. If it's going to be a real issue and they do not have a larger vehicle available, you might be able to claim back the cost of a hire car from the dealer.

I have patiently waited for my new focus RS for 9 months without complaining. On the day arranged for collection the ford dealer advised there was a dent and chip in the drivers door paintwork. They assume it happened whilst in their care but it's all very vague. They have promised to sort it but I am very disappointed. I do not want to reject the car, as they cannot promise I will get another, due to the rarity of it, but haven't been offered any form of compensation either apart from a discussion saying they will make good. What are my rights?

Looking for a straight answer; having purchased a Renault Kadjar less than 6 months ago; I have since found an implosion of paint on the door frame, which will require the car to have a re-spray; this will mean some blowing in of the paint across the door panel and rear wing.

Any re-paint will devalue the car when it comes to re-selling the vehicle, as is my plan next year. I appreciate that I have to allow the dealership one opportunity to repair my vehicle but does this also include re-spraying which has a detrimintal effect on the value thereafter?

Additionally I am being offered a Renault Capture (a smaller car) as a courtesy car for 2wks whilst the repair is being carried out; can I not stipulate that I need a like for like vehicle given I have a dog and a wife a teenager and a much younger child. What are my rights on both accounts?

Hi there I bought an Abarth and was super happy at the time. Before negotiations I asked if there was a delivery option and I was told that we could sort something. So I come down bought the car and loved. Signed on the dotted line and then 2 hours later I get an email telling me they have no driver available and that a recovery truck for an ridiculous price is my other option. Can I still get a refund if I don't have the car but I have signed the agreement and have paid for it???

As it's less than 6 months (but more than 30 days) since you purchased the fault is presumed to have been there from the time of delivery. It is for the retailer (car dealer) to prove that this was not the case. If it has been over 30 days since you purchased the car, you will likely have to allow the retailer the opportunity to try to repair it if any issues arise (replacing the car being disproportionate to the cost of most repairs). If the retailer can't repair the car, or have tried to repair it and the fault still exists, you will be entitled to return the product and receive a refund. However a reasonable deduction may be made by the retailer to reflect your use of the vehicle in the preceding months.

I bought a new Ford ecosport on the 26th March within an hour of buying I took the car back as it had a chip in paintwork and the front heated seats did not work. I was told bu the dealer to call the following week to book an appointment to get them both repaired. They repaired the chip however couldn't Fix the seats and said they would need it for a couple of days to repair, rebook ed again and still couldn't fix it. They have said that it's a mis build from ford. Between the dealer and ford they have still not managed to repair the fault and the last software update they tried adding more faults to vehicle. I have now been without my car for over a week and awaiting a Ford field engineer to look at it but the earliest they can is 18th June, what are my rights for reimbursement or a new vehicle as it clearly wasn't checked correctly when sold.

I bought a fiat 500x on PCP. Within 2.5 weeks it was involved in accident where brakes failed. They have conducted checks and state no faults with brakes however I completely disagree as my husband was also present and saw my actions. Warning lights came on afterwards. These have been dismissed by fiat and I've been told nothing they can do. I don't want car back as feel it's unsafe despite what they say. I'm 5 months pregnant and don't feel safe getting into car again. Complaint raised with fiat and finance company but all seem to indicate it's tough as the report shows nothing wrong. Feel I'm being called a liar, inadvertently. Help please

Were you given a delivery date when you ordered? If that's not been met by some margin you may be able to claim some compensation for breach of contractual terms. It's not often that a specific date is given on car deliveries however. As for the damage, it is quite common for some minor damage to occur during in transit and the repair will not be noticeable. The dealer might offer you some compensation or a free first service etc as a good will gesture. You say that the car is no longer a "new car" - you can find its manufacture date on the V5. It's unlikely it's actually been in transit for the past 10 months.

I put a £500 deposit down to secure the new Focus RS last August. 10 months on and after many delivery date changes the car was delivered to the dealer last week. Today I was informed the car was damaged (a chip on the door) and ford have authorised a repair and respray so my date to the ownership of the car had to be pushed back a further 2 weeks.. To me this is no longer a new car as its not perfect and having a door resprayed. Do I have any rights to demand a reduction in the price?

It appears that Nissan (and certain dealerships) have a flagrant disregard for the consumer rights act and have also told me yesterday (31/05/2016) that I "can't reject" a vehicle and they have a right to repair it -which is completely nonsense. I only called Nissan because the dealership had told me that they "don't do refunds" (this was 2 days after taking delivery of a car to find it was full of water having had unreported poor quality damage repair work done).
So both (knowingly?) talking rubbish.
Luckily the dealership admitted it was not fit and had already accepted my rejection before Nissan said this. So who should they be reported to for lying to the consumer?

Hi 4 weeks ago I brought a brand Mercedes c class coupe from mercedes. Approx 3 weeks after I picked up the car the engine management light came on and the car started to vibrate and judder while driving. I returned it to mercedes and stated that it was a faulty sensor and replaced it. Yesterday the same issue arises again it is now 31 days since I've had the car but the issue has clearly not been resolved by the initial repair. The car is currently with mercedes. I wanted to know what are my rights and options here as to be honest this is causing me a lot of hassle and don't really feel safe driving the car anymore. Can I request a replacement or money back

hi, i purchased a rangrover evouge last monday. i test drove it 10-15min. i almost had for 2 days I realised the friver seat gives me back pain. since on the day before signing the contract i asked the sales woman what is their return policy. she replied 30 days no question asked. hence i called 3 days after pointing out my problem. she said bring the car back lf we can not fix it we can take the car back. since i like the car and would be happy withe change of the seat i didnot mind it.at the day of meeting at dealer she totally denied the 30 day mony back and she sady

In general once you pay a deposit on a car, it is taken off sale and the only reason it would cover a few miles is to be taken from a garage to a valet service for example. If the car you thought you were buying did not have dent in it, you may be able to claim a refund. You'd be better to ask for professional legal advice on this one.

Bought a brand new car from Arnold Clark in Feb. We washed it at the weekend and when the sun shines on the paintwork it's covered in marks as those wax hasn't been buffed up. Took it back to Arnold Clark they think it's a defect and told us to contact fiat but as we bought the car from Arnold Clark I think they should look into this for us rather than us travel taking our car 30 miles away to have it looked at

If the garage is asking for more money than was agreed and signed for, they are in breach of contract. Your son should state that he will continue with the payments as originally agreed. If they threaten further action, he should seek a short consultation with a solicitor...they often offer the first half hour interview free of charge or for a low fee.

I've recently purchased a car from a local dealer. After being kept waiting for quite some time to collect the car the salesman advised me that there had been an accident and the car had been dented on the door frame but they would collect the vehicle next week while I'm at work and mend it.
Stupidly I agreed to this, completed the documents and once I'd arrived home realised that there was approx 173 more miles on the clock than there had been when I put the deposit down a week ago!?
The milage in the advert and when I test drove the car the 2nd time/left a deposit was just under 200 short of 22000. When I paid the deposit a document was provided to me with my receipt confirming the milage as 22000. I assumed that the milage had just been rounded up as they had also rounded down the mileage on the vehicle that i had traded in, so I didn't mention it.
Now with the knowledge of the extra mileage and damage I am quite concerned with what they have been doing with the vehicle and don't know where I stand as I have accepted their offer to fix the damage?

As this is a used car, this article is more relevant. If it has been over 30 days since you purchased the product, you can choose for the retailer to either: Repair the product, or replace the product. The retailer may however refuse one option over the other, if they can show that your choice is disproportionately expensive compared to the alternative.

My stepdaughter purchased a second hand car on March18 and on April 23 the tensioner broke so it was towed back to the garage. The cost of repair is greater than the cost of the car so they have offered a choice of other cars at the same price with nothing to pay. If she decides they are not suitable or doesn't want any of them is she entitled to a refund under the Consumer rights 2015 or does she have to accept a car.

April 2015 i bought a brand new Nissan X-trail , a year later and 21,000 miles it lost power whilst driving and was recovered to our dealer no warning lights came on. The dealer is saying it is the DPF and have said it will be covered by the warranty they state we will be liable for labour being around £700. I have disputed this and complained to Nissan UK but a week later no further nearer to getting it fixed and i am without a car for work. Any advice. Thanks

bought new nissan juke tekna in feb 2016. had damage to the central console yellow paint was chipped around cupholders they agreed to get a new part and fit it. took it back to have fitted week later when i went to pick it up thevgirl who gave me the keys said its all done and she knew it was a new part because they had taken it off her company vehicle so not a brand new part as promised.on getting in car to check it i noticed three little grooves around the cupholders where the original damage was ran my nail gentle across caught in one of the grooves and small piece of paint chipped off went back in got her to look at it and she said she would get salesman to give me a ring when he came back in. he rang and asked me what had happened i told him and he then accused me of attacking my vehicle after a heated discussion with him and a manager both going down the same line took the car back into them. similar story with salesman and manager at dealers blaming me they offered to respray it . i refused this offer and went to nissan themselves to intervene after several phone calls back and forward with them me and the dealer they finally put a new one on. then two weeks ago i was driving back from devon to bristol on straight road no bridges or anyone in front of me when my sunroof exploded outwards showering the car with fine shards of glass.rang dealer wessex nissan cribs causeway they were most unhelpful so drove car back to their main branch in penny well road they were most helpful and gave a replacement car while they investigated.result was they said it was not covered by warrantee as it must have been caused by external forces .have lost confidence in it now and trying to reject it

I've got a 2015 vw amarok pickup truck. It's got lots of white patches all over the metallic paint. I took the car to VW for warrenty and they claim that it's down to paraffin found in cosmetics and hand creams etc. So now I have a 2015 with horrendous paint work, cos I obviously like washing my car in suntan lotion. So what are my options? They are refusing to accept warrenty. The car has 15k miles on if and a year old, I could understand the car being 10 years old but I pay good money to end up driving around with something like this. Clearly the car is substandard and not fit for use of normal day environment conditions can damage a car paintwork then the quality control is poor. Can I return the vehicle? On 31 March I ordered a brand new car online and paid £200 deposit. Vehicle delivered on 4 April but not until dealer insisted I pay the outstanding amont of £5k. Foolishly I agreed and paid by debit card. Upon inspection I found a couple of scratches on paintwork which I did not think was acceptable for a new car. Sent driver back up to the North West. Telephone dealer to cancel order as I have not signed any contract / paperwork. I have also written to them quoting this Act etc. Where do I stand ? They are also refusing to return my calls / emails as well.

Check the terms and conditions of the contract you signed. In general unless you were give an specific (rather than an approximate) delivery date there's not a great deal you can do apart from cancelling the order (check that you will not incur penalties).

On March 24th I took my wife into Bristol Street Motors to buy a new Vauxall Corsa, we done the deal with the date of the 31st of March being the deliver/collection day, on the 29th March my wife was asked to pop in and sign the paperwork for the finance.
On the 30th March we were told they did not have the car and it may take a few days to get it to the dealership, we were given a new collection date of 5th April on Monday 4th April we received the log book for the car in my wife's name, on 6th April we then received a call from the dealerships insurance to say the five days free cover was up yet we still do not have the car.
The dealership is now saying we should take delivery of the car on the 8th April, this means by the log book we have owned the car from he 31st of March but as of today we still have no fixed collection date, can I refuse the car and go elsewhere.

My daughter recently bought her first car, on finance, from a dealer. She has had the vehicle around 3 months now. She was told by the dealer that it was an eco car and her road tax would be £30 a year, one of the main reasons she chose this car. The paper work shows 'road fund licence (CO2 120g/km' this means her tax will be £30 a year. After going on the DVLA web site it is showing the vehicle to be a 121g/km which means her tax is actually £120 a year. We have contacted the garage and they admitted that the 60 cars they sold were wrong on the emissions and it was their mistake but are not willing to do anything about it. Surely we must have some rights here, please help

On 3/05/16 I bought a brand new truck at night. In the few days I noticed the left back end of the car panels where off by a big margin compared to the right side of the car . A local dealer was unable to find me the car I chose nearby, and have found one some miles away which they have arranged to have brought down to the garage for me. It is a brand new car. They have said that it is standard practice for them to drive the car down (putting over 100 miles on my brand new car), instead of having it trailered/transported on a lorry. I am not happy with this. Are they right that it is standard practice? Or am I within my rights to demand that I accept it with 0 miles on the clock?

A warranty should have no impact on your consumer rights. If you have owned the car for less than 30 days and it becomes faulty, you can reject it under the terms of the Consumer Rights Act 2015. It is sometimes better to let the dealer try to rectify a problem first as rejecting it can be time consuming process. If you have purchased the car on finance, speak to the finance company for advice firts (as they are in effect the owners until you have finished paying for it).

I have just been told by Nissan that they reject my rejection of my brand new car that has only been driven for one week. My car produced an engine rattle within the first few days of driving. They claim that once they find the fault they will repair this under the warranty contract I have with them.

Sorry is this acceptable to have a car that is 1 week old with a fundamental fault repaired.

Do I have still have the right to reject under the consumer rights act even though the car is under warranty?

I purchased a Nissan Qasqai 1/3/16, after a few days of driving the engine started to rattle when accelerating. I have taken the car back for them to look at. Nissan have never had such a fault and will need to investigate further. At this stage of spending over £20,000 can I reject the car, they have told me it I cannot drive it so I guess it is not fir for the purpose it is intended. Can I demand a new one?

I bought a 13 year old Ford Focus last May from a local dealership. I've just taken it in for its MOT yesterday and the person doing the MOT has basically said the car is dangerous to drive and the brake pipes are so corroded that they could burst any minute. He also said that the issue would have been there long before we purchased the car. Having checked the MOT history online, it's previous MOT's in 2012/13/14 all had corrosion on the brake pipes as an advisory yet it's last MOT in March 2015, 2 months before we purchased it, had no mention of corrosion on the brake pipes despite being told yesterday that there would definitely have been corrosion on the brake pipes back then due to the severity of the damage. We've now got to write the car off and can't afford a new one so we're now without a car. Do we have any rights regarding this or is it pretty much our mistake for buying the car? Hi. I have bought a brand new Mercedes only 3 weeks ago. The parking sensors broke whilst I was driving down the motor way with no one or nothing in sight. I have rang Mercedes who have now done an inspection to say a stone chip has damaged the sensors. How can a car that cost me £45k break that easily. I am really disappointed and they are now wanting to charge me to fix it. Have I got any rights? As I don't believe they are selling a car with a specification fit for purpose

I have just bought a brand new vehicle which i was suppose to collect on 1/3 but the date was put back 7/3, just before collection i receive phone call saying that the front door has been damage. The dealership said that it will replace with new door putting the delivery back two weeks they have given me a loan car while the repair is carried out.I am in my rights to expect some good will gesture or compensation ?? The value of the car is in excess of £25,000

Unfortunately it's unlikely you'll be able to do much about this. The dealer gave you the option of refusing the car at the time and waiting for the correct one. You would have been better off keeping your old part ex vehicle for a while long and negotiating an extra from the dealer to compensate for the incovenience etc.

On the 1/3/16 I went to pick up my new Nissan xtrail, White 4x4 which was ordered one and a half months earlier. As I walked around to the front of nissian I noticed my new reg and had a quick look at the car and through the window I noticed no 4x4 control knob, feeling the blood draining from my head I thought maybe this models slightly different, but that's ok. Manufacturers change little bits here and their. So I get into the showroom and I say hello to the salesman, he tells me to sit down for starting to sign my life away and I mention to him that theirs no 4x4 control knob and he says to me no it's a 2 wheel drive, so I say that's not what I asked for he says yes it was bla bla bla when he finally prints off half a forest sure enough it should have been 4x4 and he starts going pale. He's ordered the wrong car! I'm not happy with it but he says if I take it I can reduce my monthly payments by £35ish the time at this point fannying around was 1415 and I need to get going soon to pick up my kids from school 10miles away. He's very sorry completely. He's says I can leave it their and order the correct one. Feeling under pressure because of the time and they have just bought my other car, I have no car and need one now I take it. Now a few days on I feel gutted and to put the cherry on the cake it's been snowing all night and still snowing know at nearly 11:00 maybe a 4x4 would of been handy??!!!!! I just want to know we're I stand or is it obvious that I've signed and that's the end of that. I love the car it's really nice it's just left a bad taste in my mouth...... Thanks for listening

So I bought a 7 seater on the 6th /2/2016 with a fresh mot that day , the next day I went to strap my car seats in to notice one of the middle seatbelt recievers was totally broken rang garage they said would order one , waited 2 weeks then has the car check by a garage to find out something on the last two mots before I purchased still hadn't been done and wasn't on new mot , anyway cause it was under warranty garage said they would fix these problems , took it there a week ago but still not got it back , my warranty runs out the end of this week , they have given me a curtisy car but it's a 5 seater and with 5 kids we can't all fit in also with seat belt problem havnt been able to fit me my partner and my kids in the car since I bought it , my older girls have walked to school most days apart from when raining heavily with it being a half hour walk have got them a taxi when weathers been bad , feel rather annoyed that I have spent £100 on taxis because of this also the fact I only got 4 weeks warranty and its been at garage for a week so lost one weeeks warranty at least . This wasn't a cheap banger we paid £3500 anyone got any advice please

You have paid a deposit and signed a contract, the price cannot be randomly changed by £1000. If the dealer does not want to go ahead with the sale, they must give you a full refund.

I bought a new passat cc in November 2015. I have had the car 11 weeks had a few problems with it and was booked in at main dealers for warranty work. But the car had a dashboard fire which fire service says was due to a electric fault. Can I reject the car as not fit for purpose. As volkswagen say it may not be covered under warranty. Which I disagree.

Did the salesman give you a specific figure? Did you check out the technical specification of the car before you purchased it as well as relying on the saleman's chat? How far off the saleman's figure is your fule consumption per mile? If it's vastly different e.g more than half as much again, then maybe they could check to make sure there are no faults. It could be that your driving style or the types of journey you undertake are such that your consumption per gallon will be higher than the suggested figure. You should have been given an urban figure and an "extra-urban" figure for fuel consumption.

One of the selling points and the main reason I bought the car was its high mileage to the gallon , having had it since September its actual mileage is way below that which I was told it would do by the salesman. As you've been put to inconvenience already, and the retailer has tried to repair it and the fault still exists, you will be entitled to return the product and receive a refund. However a reasonable deduction may be made by the retailer to reflect your use of the vehicle in the preceding months.

I bought a Kia brand new off of the forecourt with only 10 miles on the clock.

On the day I drove it away, the car broke down and the garage had to come and replace the battery as I was stranded at a petrol garage based on the fault. The car worked after changing the battery. I drove it away.

Then two weeks later, the car broke down again. The garage came and collected the car and gave me a lesser car in the interim. The following day dropped the car off saying they found no fault. The car worked so I continued to drive it.

Another two weeks later and the same has happened again. Car broke down, they came and collected the car, given me a replacement car that is not equivalent to the car I purchased and have suggested that I will be without my car for a while until they can 'replicate' the problem.

I am fuming. The car clearly has a fault, doesn't appear to be fit for purpose, and has left me in some pretty precarious situations.

The car is purchased through HP.

Where do I stand? Can I request a full refund? For everything I have spent on the car including the first months payment? I know it is past 30 days, but I have captured these errors well beforehand and don't believe I should be paying for something that is not fit for purpose and has not been fixed as promised within the right timeframe.

Any advice would be appreciated.

I bought a car just over a week ago which had no service history. I booked it into the main dealership for the service and they did a free health check on the car. There were many problems with the car some of which caused it to be dangerous to drive. Also, it had a new MOT which could not be authentic due to the serious problems. I informed the dealer and he told me to take it back to them and they would repair the car making it safe and fit for purpose. However, they don't seem to be in any hurry to do this. Is there a time limit on how long they can keep the car and am I entitled to a courtesy car.

I have purchased a car the finance company have paid for the car and the day after the car dealers put the car through for an MOT, I received a call to say the car needed tyres and that they would sort this and let us know when it is ready. I have since checked the MOT details online and infact the car has a few failures and one states "Electronic stability system warning lamp indicates a fault" and other failures however when speaking to car dealer there is no mention of this fault only that the tyres need replacing. Due to the public information provided and stating there is a "Fault" do I have the right to reject the car? I do not have possession of the car it still remains on the car dealers premises, but car has been paid for and cleared through finance. If someone could give me any advice this would be greatly appreciated, I'm not saying the car dealers are dodgy or anything like that but now knowing the car has a fault and this information has been withheld from me I feel I have a right but I'd like to know if this is the case before speaking to the car dealer.

I purchased a used car 20 days ago from a large dealer. On driving it home for the first time an electrical fault flashed up saying "parking brake faikure engine needs repair and esp and abs systems faulty". I rang the dealer they took the car in and took to a Peugeot dealer who put it up on a computer. I was told no faults showed and I collected the car. Driving away again the fault showed and keeps showing. I will contact the dealer tomorrow but I do not want thjs car can I reject the car or ask for another car ?

We've purchased a car 18 months ago on finance after the first month of having it the car was in the garage for new suspensions arms on both sides at the front which was fixed and promised that nothing else was wrong then a few weeks later it was back in the garage for a whole new engine which was rebuilt, these faults have been on going now for the last 18 months and is back in the garage now having more work done on the suspension arms. we've been told it's out fault for wear and tear of the vehicle as since we've had it we've done 20,000. We have tried to give the car back and stop the finance payments as we have nothing but trouble with the car, the only option they have given us is to add to the finance again to fix the reaccuring problem as their blaming us for wear and tear. They have said if we want to take it further they'll wipe the floor with us due to the millage and wear and tear so our only option is to keep paying and have a faulty car. Are they in there rights to do this and where do we stand?

For the electrical problem, you might find the manufacturer will continue to look at this for no/or low cost as it's already been looked at under warranty. With the gearbox noise issue, you should wait until the cause of the problem has been diagnose before considering what action to take. Bear in mind that some issues will inevitably crop up once a car reaches 3 years of age.

I bought a new Outlander in 2013 (no finance) It is still in warranty for another 6 months but during the 2.5 years I had it there has been nothing but problems (many minor like reverse aid not working) and it has been in and out of the shop so many times. This has caused so much stress and taken up so much time and energy it's exhausting. A major problem was with the electrics with the indicator being that the headlights were permanently on. They had to replace a major part (I have since learnt this part has been recalled). That was a year ago and now I am suffering the same problem; the headlights permanently on again and unable to turn them off without turning the car off. So there is something wrong with the electrics again. The part they replaced was super expensive but was covered under warranty. But now this has happened again I am worried that once the car is out of warranty we will suffer more expensive problems and we will be financially libel. We were also suffering with a strange clunking sound when the changing gear but the garage were unable to replicate the sound whilst in the shop, even though when I got the car back it was clearly still doing it. It has since stopped, but it did this once before and then returned. I am at my wits end with the car and I generally do not feel like it is safe. The car hasn't been right since we got it and I am concerned that the warranty will run out soon. What can I do?

On the 2nd Jan 16, I purchased a new Jag XF from a main dealer.

Two miles from the dealer the engine suffered a major failure and the dealer is now fitting a new replacement engine.

My husband bought a brand new Dacia, collected it on 23/04/15. It was leaking in on the front passenger foot well. We returned it to the dealer 09/09/15 who had it for approx 4 weeks, they said they had replaced the seals and we took it home. It was taken back into the dealer on 14/12/15 as it was leaking in the back passenger foot well, we got the car back 23/12/15 they said they had replaced the back seals. 26/12/15 the front foot well is full of water again can we refuse for the car to be fixed and ask for a new replacement?

Hi went to collect my brand new car but on inspection the paint work was scratched I pointed this out to the dealer and walked away with out the car they wanted to polish the whole car at the body shop but I told them I did not want the car

In June I purchased a new MG3. It has leaked through the drivers window since new and the acceleration is rubbish and the garage have admitted that MG have a problem with some of their cars regarding this.

Bought a new honda HR-V and after only 600 mile on the clock when parked on a incline got out of the vehicle after applying electrionic handbrake and switching auto lights off after waking away for about 20 - 30 Meters after turning round the headlights came on and the car started rolling away and crashed into another car causing damage to both cars.
Honda have said no fault was found after a couple of days investigation said the car was ready to collect, I said there is a fault on the vehicle that is a serious defect which if it happens again could cause injury or even death. I have asked for a new vehicle as I have no confidants in the car anymore The garage is now contacting Honda technical. They have been very understanding I just need to know my options?

Anyway I've car yards wanting it and other people wanting it untill they do a revs check on it and to find out it was a repairable write off so no one wants it. Hi I bought a car on the 26/11/15 from a dealer on the hour drive home in the car the engine light came on I telephoned the dealer and told them straight away they told me to go to a local garage to get to see what the problem was and they would pay for it. I did this and it needs a regeneration so I informed the dealer and they asked me to call around the local garages to get the best quote. I did this but the longer I had the car the more things I am noticing the gear stick is extremely hard to change gear until the car warms up which is causing problems when driving the inside of the car gets condensation inside! the steering gets stuck and the accelerator has stuck to the floor several occasions, The radio is going on when we are tucked up in bed! and changes between radio and cd player the fuel door button doesn't work so you are unable to open it without wedging something into the gap this had added to the fact the car is not practical for my line of work as a childminder as its a kia caren and doesn't fit the car seats in so already hating the car I called the dealer and informed him of all the things going wrong and i was not happy and asked if they would give me a refund or find me another car which I am prepared to take out finance for he informed me that he would not refund the money but will look for a car for me but am I entitled to a refund due to the problems the car is having and needs fixing feeling somewhat stressed and fed up as I have been told by other dealers I wont even get 2'000 on part exchange for it and I paid £3500 what can I do???

Hi I bot a Saab 9.3 sports wagon lovely car 34k not a mark on it. Drove 200 miles to pick it up from well known dealer. Day after driving it home .dpf failure . Local branch of garage didn't want anything to do with it . Saab specilists are few and far btwn but I sourced on in a city 50-69 miles away . The car was taken there and dpf taken out and cleaned took 9 days lasted a day and then same fault again took back in garage and 9 days later got back lasted half an hour same fault . And finally got new dpf on and within 2 hours it happened again .took bk the garage and was stated it needed a regen. Drive for 2o mins in return dpf failure again .i have rejected the car and the company are happy to do that but my old Astra was used as a part exchange and it still had finance on it at the time 1600 they gav me 1250 for it under the belief I was getting a good deal as local dealer would of gave me 2000 for it . I want to no where I stand not having a car either as company's sold it to auction

I have just bought a nearly new Mitsubishi Mirage on finance. But unfortunately Im not really happy with it. I have found it noisy when driving it and it now feels a bit bulky for me which I didn't really notice at first. I picked the car up on Saturday but want to change it to a Corsa. I traded my lovely corsa in reluctantly. I wondered whether I can do anything. Could I change it for a Corsa perhaps? My first payment comes out in January.

I bought a car in August 2012 on finance it is a mk 5 golf gt 1.4 tsi I have nothing but problems with this car it has never run properly for more than 6 months I have spent probably 4000 getting repairs to the car, coil packs, new turbo, new gear box, timing chain etc all expensive to fix. The Eml light came on once again not long ago and came up on diagnostics as cam sensor which has been replaced but fault still coming up. My friend who is a mechanic sent the codes from the diagnosis to his friend who deals with electrics on cars who says he keeps seeing the same problem with the same model car an it is the timing chain which is out, I had it replaced little over 1 year ago but not really done many mile as it was after this the gear box went!!! I am so fed up with it all now an I cannot afford these expensive repairs constantly. I just wondered if there was anything that could be done with the original dealer I got it from? I think if I went to see them they wouldn't be much help as not longer after I purchased the car it had a fault an they weren't interested. I also purchased extended warranty from the dealer (with an outside company) who were also difficult! Making repairs long winded because of the checks they need to do and the garages they use only to say none of the repairs are covered! When my gearbox broke they said it was because I had not put oil in it which was a complete lie! I always checked my oil. Jst don't know where I stand with all this....sorry for the essay..

You should not be put to any unnecessary inconvenience but the retailer should be given the chance to repair the vehicle. It might be worth contacting your finance company to see if they can offer you any advice as the car is not "yours" until it's paid for.

I brought a brand new Vauxhall corsa 2 weeks ago on finance and after leaving the dealer with my new car i noticed a stain on the upholstery and i infomed the dealer of this. The dealer took the car to be looked at and the valeters tried to get the stain off and they spayed a substance on the stain to try and remove it however the stuff they used has stained the upholstery more. The car has now had to go back to the dealer to be sorted and I have a courtesy car for 5 days while they try and resolve the problem. I am very stressed out as i did not expect to receive a brand new car with a fault and already have to give my car up for 5 days. Any advice would be greatful and can I return it if i am not happy?

I baught a brand new car from a main dealer this week. Two days after I picked it up I noticed a ripple/crease on the front wing with a very small crack in the paint. Very difficult to notice if you never knew it was there. I took it to dealer, and I'm waiting in a reply. They said they would repaint the crack, but not sure if they will smooth out the ripple. Should I dig heals and demand a warranty repair if they refuse to repair body work? I have a feeling they will blame me for not noticing on the day I collected car. Having inspected the ripple more closely it looks like it has been dented, and they have tried to push dent out from behind the wing to conceal the damage
Any advice welcome

Hi, I purchased a 2012 Chrysler 200 limited from a local dealership on Memorial Day of this year. We test drove it and it had a hesitation. We told the salesman and he said the computer needed to be reset and it will be good to go. So we bought the car and picked it up the next day. The car still did the hesitation and we took it back only going half a mile down the road. Well its been 6 months now and no car. What should we do? They refuse to give us our money back and they cannot find another car to replace this one...

I purchased a new BMW 535iTourer (£49K) on 14 Aug 15 from main BMW dealer. On the 21 Aug15 whilst driving to Guildford on a perfectly good and clear road there was a sudden explosive/bang from underneath the car and fuel was then leaking under the car. Car taken to BMW garage and after inspection informed me that I had run over something. There was no evidence on the road or surrounding area that could have caused the damage .. Three fuel lines had been damaged. I am not disputing that there was damage (which I inspected). To this day it is a complete mystery. The Police and Highways Agency found nothing that could have caused such damage. I have written to both BMW CEOUK and CEO Munich. Passed to Customer Services who are not interested and said no warranty go to insurance. BMW have been utterly
negative over this matter from the start. My wife and I have completely lost any confidence in this car (it has been repaired) and would want to return it to the dealer where I purchased it. The whole matter has been dealt with terribly by BMW .
Any advice would be much appreciated.

I have a 2012 VW Caddy 1.6 TDI BLUEMOTION panel van .
Its on a 4 year finance lease which i have a balofferingyment due in March 2016.
due to the emmissions scandal not many dealers will touch my van on a trade in and ones that will are offering rock bottom.
im sure ill be in massice negative equity in march as my van may not be fixed by then.
emailed VW twice , rang them twice but no responce in last 2 weeks.
emailed citizens advise today.
why can't i just give them the van back as its cleary not what they ( vw ) advertised it as.

Was it a used or new car? Bespoke/Custom requirements or not? Generally you automatically get a 14-day cooling-off period when you buy something you haven't seen in person - unless it's bespoke or made to measure.

Have signed a contract to purchase a Jag xf from a London dealer. I have also paid a £1000 holding deposit. I now want to cancel (Signed 20/10/16 yesterday) can I do this under the distance selling rules. I have never visited their premises.

In April of 2014 I purchased a brand new Vauxhall Astra GTC biturbo from a Vauxhall dealer. In the first 6 months, the car broke down twice, both of the same problem with a failing DPF Filter Sensor. Which the dealership put down to being "very bad luck". Regardless I particularly wasn't too happy about it the second time but allowed the repair.
I am writing this from a flashing hazard-lit car, currently awaiting recovery from what appears to be the exact same problems as before, 18 months after purchase. (Car is financed via GMAC and is still active on the "lifetime warranty" Vauxhall included with the sale)

Is anybody able to advise of what my entitlements are; be it refund, replacement etc.
Any replies would be greatly appreciated, whilst I sit and await the AA.

My nephew purchased a nearly new car (BMW) on finance about 5 months ago and the engine has just blown up. They are replacing the engine under warranty but he is not happy to keep the car now. Has he any rights to another car?

This really depends on whether you asked for a demo model that was the same as the one you intended to buy. Some responsibility for investigating the model and features of a vehicle before purchase, has to rest with you the buyer.

I purchased a Range Rover Sport HSE from a main dealer. When I got the car I realised the ride quality was not as good I a remember when I the lent me one of their demos.

It turns out the demo car had a different suspension option of which was not pointed out to me prior to ordering so I am not happy because does not ride as well as I expected.

Can I return the car and demand a replacement with suspension option without paying anyting extra?

I have an Audi and a vw, both affected by the emissions scandal, my Audi I have on pcp and is only 10 months into contract, my vw on hp and nearly paid. Frankly I want rid now as I've lost faith in them which shouldn't be too difficult with the vw, but is there anything I can do about my pcp Audi? It was an expensive car and now I know it will have lost value already I feel trapped with this car I don't want. It was bought directly from an Audi dealer.

My daughter has, within the past three weeks, purchased a VW Passat, which is likely to be effected by the diesel emissions scandal. Her purchase occurred a matter of days before the facts of the emissions concealment/manipulation became known, by the public at least! As the car is likely to be blighted by what has taken place, can she return the car and state that it was not as advertised. This is clearly the case given the admission by VW and the findings by other parties.

If the faults continue and you are put to more incovenience timewise and through not being able to drive a vehicle that you own, then you could eventually ask to return the vehicle. You will not be given a full refund as the dealer will want to make allowances for the use you have had from the vehicle, depreciation etc.

I bought a new Fiat Panda mid-July and within 2 days the clutch went due to a faulty slave cylinder and faulty washers. The garage supplied me with a courtesy car for the week while they repaired the slave cylinder.
Within a week the car was back in the garage as the 'shift gear' ligh was stuck on shift down while driving at 70 mph in 5 gear. The garage ran diagnositic checks but have found nothing for this intermittant fault.
2 weeks after this I noticed that the washers on the front windscreen were still not working and the car had developed a problem with the central locking not always locking first time.
The garage have replace the door latchs and have had to replace the pipes for the washes as these were also faulty, and once again supplied a courtesy car while these were repaired.
I have now lost all confidence in the car and wonder if I am entitled to return the car under the Sales of Goods Act. Please can anyone offer any help with this?

The dealer has the right to attempt to repair the car first. As long as you are not put to significant incovenience waiting for the repair (i.e you have been offered an alternative vehicle), you cannot claim a refund.

I bought a brand new 65 plate Nissan Juke on a PCP deal and picked it up last Wednesday. On Friday (after having the car for only 48 hours) the car broke down and steam was coming from the bonnet, I returned the car to the dealer. I have had a phone call today from the dealer saying that it is the cylinder head and it will take over 3 weeks to get the part and repair it. What options do I have? I have lost all confidence in the car and I am devastated :-(

We bought a Kia ceed sportswagon on July 31st, 2014 so it is just over a year old and has done 9,000 miles. Since December 2014 it has been in the garage 5 times with the same fault. They have replaced the part twice and partially rewired parts of the engine, the engine management light has come on again now. I have spoken to the salesman who sold me the car and we have been offered the car to go back in and go on diagnostics or have an early upgrade. I don't really want to have to pay anymore money on an upgrade, so where do I stand and what are my rights on asking for a full replcement.

I bought a c max car from fords of Winsford in may this year 1 month warrenty the engine splutter at low speeds 3rd 4 th gear took car back and they said nothing wrong with car .
When to an other garage they said fuel injectors faultly
AA going to check car.
What are my rights for compensation as it has made my wife I'll from it all

Firstly report the contract issue to Trading Standards...especially if you are aware that this dealer might be doing the same thing for others who are caught out by it. If you're not happy with the repair, take it back again to the dealer and tell them you're not satisifed.

Advice and a warning to others my daughter last week bought a new kA from our local dealer she put 3k down and financed the remaining. The finance was agreed over 36 months at 154.00a month. Everything was signed and she was to collect the car after a few days. The garage called said you have passed the ford finance come and collect your car. The morning she went to collect the car there seamed to be a problem and after keeping them waiting about (they needed to get to work) the sales man came out and said they have altered you contract its now for 40 months but your payment has gone down. Only when they looked at the contract closely did they see the payments had only reduced by £1.00a month. In effect the car price had gone up. My daughter and her boyfriend said what's going on they were told ford was not supporting the discount. Luckily they are not daft and said no way we signed a contract you agreed a price. The garage did back down and agreed to sell at the original price but we have since spoken to a x employee who said "the garage do that a lot they especially do it to elderly people".

Matters are now worse the car was brought home 1 mile away and my daughter and her boyfriend went to work. When they got back home I went to check the car out and noticed a huge scratch on the inside panel and a chip in the door where the door had been opened onto something. The car was parked on my drive and no way we could have caused this damage. The car was taken back and repaired today. Unfortunately they only replaced part of the panel scratched and not the steering column also scratched , and simply put some touch up paint on the chip, you can still feel the chip. My daughter can't stop crying she does not want the car is so disappointed in her purchase and feels totally exhausted. What can we do

I purchased a brand new SaangYongTivoli SE a month ago and have had problems with the central locking system and car alarm as wll as a irritable sqeak from underneath the car. It has been in the dealership garage twice and the problems still persists. The car is once again in the dealership garage and they have provided me with a car for the length of time to effect repairs. Can I demand a replacement car?

I purchased a used Vauxhall Insignia 64 plate 2702 miles at point of purchase. I paid this car via my debit card (no finance) at first the car was having issues with gear changing. It didn't feel smooth and at times struggled to go into gear. Also losing power & generally feeling sluggish also blubbering on start up. The car has been back to dealer three times. Once for the service that they didn't give it before I collected it and for diagnostics. Once for them to test drive it with me to try and find out what was wrong with it and then in for 2 days for them to fit a new clutch!!! I've got the car back today and it's intermittently sounding like a tractor, hissing/whistling when you accelerate and the gear issue is still there!?!?!?! Can I take this car back for a refund. I want nothing to do with it this is the 2nd car they have done this to me with. Any advice would be gratefully received. Thanks.

I purchased a brand new Vauxhall gtc in mid July 2015 , which as a paint defect all under the laquer. Initially I noticed them on the bonnet but was going away for 2 weeks ,since then I waxed the car , and have noticed purple flecks under paint some are proud but the majority are under the laquer on every panel , I'm taking the car in to the dealership Saturday 30 August for warranty chap to look at . I don't really want the whole car painting never as good as factory finish .can I demand a exchange for a new one, Any advice appreciated thanks

You could try claiming for damages under the Misrepresenation Act (1967). Note also, that you do not have to have a vehicle serviced at a Nissan dealer/franchisee - it will not invalidate any warranty if the vehicle is serviced at an independent garage (there are lots of good ones around - ask for recommendations).

I bought a Nissan Qashqui for my Granddaughter from the High Wycombe Nissan Dealer specifically because they were her nearest garage for servicing the vehicle. I explained this to them before purchasing, so you can imagine how angry I am to find they knew they were ceasing to be Nissan and are now Kia Dealer and the nearest Nissan Dealer is Aylesbury an hours drive away.

The vehicle's Sat Nav/Music system was installed incorrectly and had to book in to have it fixed in Aylesbury. Due to the fault in the system it calculated the journey time wrong so missed slot by 20mins. Then told had to wait for 1hr 30mins for the next slot and then it would be 2 hours waiting time. She has a 2yr old in tow so we are not happy or impressed with Nissan at all.

Would never of bought the vehicle if had not been lied to by the salesman!!!

I bought a brand new car from vauxhall it broke on the forecourt, they then got me another brand new vehicle, which had been scratched all over needed a new wingmirror and window seel. The window had started to grow mould. What compensation should i expect? They have been tryig to get scratches out for the last week. Thanks

FORD problems.

I have bought my brand new for focus its a 63 plate had December 2013, with in 13 months the engine blew up and after dramas and being promised the world they replace the engine the car had only done 18,000 miles engine should not be blowing up, I put a massive complaint in sevral times and was promised the world but all got dussed under the carpet. I reluctantly bit my tounge and thought Ill easy get my money back with a brand new engine in it, so picked the heap off s*** up went to a dealership to sell it has they offered more than was out standing on the finance, but when getting there and numbers not marching up got a bit awkward, plus the clock still showed 18,000 on it so I thought i will just keep it for another 2 years then trade it in, in the mean time 7 months later the clutch started playing me up the car is now 25,000 miles they fobbing me off with its wear and tear now this is my 3rd brand new car from the same dealer and feel they have SOLD me a dud car, the car is at the dealers and i am very close in taking the log book and spare keys back I am at my witts end I need my car for work and family the whole reason I buy new cars is for reliability but keep breaking down now I spent quiet alot of money on this car purely for reliability but not the case don't buy FORD customer service is rubish, SORRY ITS SO LONG WINDED JUST NEED TO VENT IT OUT...

I bought a brand new Toyota auris from Toyota dealership in November 2014, and have noticed quite visible fade on one side of the car. What are my rights (if any) about getting this repaired as less than 12 months you don't expect fade already.

You can try insisting on a refund but bear in mind you will not get back the amount you paid for it. Under the Sales of Goods Act, the retailer can offer a repair, refund or replacement. If the repair turns out to be "shoddy" or you are put to significant incovenience as a result of waiting for the repairs to be done then you may have good cause to demand a refund or compensation.

Not sure what to do. Having just spent £48K on New motorhome, after 3 months have discovered long cracks appearing on one of the plastic moulded external panels which run top to bottom adjacent to passenger door. This panel also appears to have been incorrectly fitted and does not line up with the Fiat body. The manufacturer has offered to repair the panel, this I believe will reduce the resale value. The alternative would be to completely replace the faulty panel, which again would be difficult and possibly affect the resale value. The vehicle is now 4.5 months old, should I reject it and try and get a refund. I hasten to add this is not the only fault we have had with the product but it is the worst. Any assistance would be appreciated.

@Maddog. Gosh this is a difficult one. It's highly unusual for a vehicle not to have a heated rear windscreen these days and if the button/selector was there, you'd assume it to be an available option. Trading Standards might be able to help you take direct action, otherwise you might want to try a solicitor - many offer a free half hour consultation.

I bought a Ssangyong Korando Sport 4x4 to replace my old car to tow a caravan, when I was buying it I made this purposely apparent that this would be the cars main function.
An excellent choice said the salesman, you won't find anything better for the same price and he was correct, the problem I have is that the rear cab heated window does not and has not ever worked, the reason being that it wasn't wired up to the fuse box.
I told the garage who sold it to me that I stated it was going to,be used to tow my caravan and neede to be able to see out of the rear window.
Fetch it back and we will sort it but it will cost you £150 they said, I don't think so I replied firstly it is under warranty and secondly I told you what I wanted the car for, after much haggling and contacting the manufacturer Ssangyong agreed to pay the cost so I returned the vehicle for a full day only to,be told at close of business that it couldn't be done.
Being rather upset at his reply I then contacted the manufacturer and one of their engineers then informed that, the rear cab I had was what's known as the classic and although the rear window has got wires in it, it was never meant for use, my reply was well that's like having wind screen wipers but not wiring them up or indicators or a radio.
The point I am trying to get a cross is that I have been sold something that is not fit for purpose and as I see it is also a danger to both myself and other road users.
I have written to the managing director of Ssangyong but had no reply, I have basicly been cast a side and forgotten.
The question I want answering is, who is at fault and who is obliged to correct it, I have further found out that the new models have a different cab and the rear heated window does work on this one.

Hi I bought my car last July and was told it was a brand new and I was it's only owner. This was from a dealership I then reviced a letter asking to buy my car back so I went dwn and the offered me 6500 which is rubbish as my car should be worth 8 too 9 thousand. So I when to a different dealership and was told tha the car I hand bought had been pretty registered by the dealers and the market value had deacresed it so I confronted the manager who said you signed for it so nothing he can do about it which is rediculas I have already have had problem with this dealership and made complaints about prioviously not been aware of negative equity on a priovous car. The manager did the same last time. And I am now a wear that he was sacked for doing doggy dealings any one help me out please. Thanks

@FumingFordBuyer. this is not unusual unfortunately. The best thing to do is accept it and move on. Make sure you get your deposit back and go to a more scrupulous dealer when you return from your holiday. If you wanted to claim the cost of any losses (eg. having to MOT your vehicle) then you would have to do so via the courts.

Last Sunday I signed a contract and put down a holding deposit to purchase a new car and part ex mine in. I have just had a phone call saying in a misunderstanding the car had already been sold! My car is only mot until the 31st July and I go away on Tuesday what rights do I have and how do I approach this. At the moment they are failing to ring me back!

@Misrepresentation. If you were told it was a factory order and it wasn't then yes you are right to reject it on those grounds. Likewise if the vehicle was not in satisfactory condition when you came to collect it then the dealer should have offered an immediate repair, refund or replacement. You may need to seek additional help from a legal professional here, but try your local Trading Standards to see what advice they can give you.

I was looking to buy a brand new nissan qashqai of a certain colour. I was told that my colour choice would mean a wait of 4-6 weeks. However, the dealr mentioned that another colour was available within 7-10 days stating certain not-very-popular coloured cars are made quicker due to the order queues in the factory. Since I was keen to take delivery of the car sooner, I agreed for a different colour choice. The dealer clearly mentioned that car will be coming from the factory several times during the deal process. What they did hide from me was the fact that the car was already in the showroom's garage gathering dust. They were trying to shift a dead stock to me by mis-representing that my car will be coming from the factory and completely concealing the fact that they already had the car with them (unregistered though). I was unaware about the whole things. While I went to take delivery of the car, there were 30-40 scratches (unacceptable for a brand new one) on the inside and outside of the car. To top it, it was covered in thick dust in all crevices possible. The dust collection looked unusual for a car that has just come from the factory. It seemed fishy to me and I refused to take delivery of the car. Soon after I found out with the VIN that the car was manufactured 2 months before I even placed the order. I have asked for cancelling the contract of car purchase and the PCP on grounds of mis-representation/miselling and good not being in satisfactory condition while taking delivery. But both the finance company and the dealer are refusing to do anything about it. Manufacturer is not helping either. The car is lying in the dealer's garage and money is being taken off my account for the PCP. Is this not mis-representation and an unfair sale practice? Do I not have the right to cancel the car purchase?

@Angry with Ford. You'll need to get an impartial expert opinion on the cause of the damage. Ford may be more receptive if it can be proved that there was a fault at the time of manufacturer rather than something that has been caused as a result of wear and tear.

Hi,
My partner bought a new Ford Fiesta in 2011. We have never had any problems so didnt extend the warranty. Unfortunately 6 months after the warranty expired the engine blew on the motorway and we had to have it towed back to Ford. The Ford Mechanic confirmed there is a hole in the engine and Ford Customer Services have confirmed they wont do anything about this without giving me an explanation. Do I have any rights? What would be my next step as I have raised a complaint with Ford but they have not responded to me.

I bought a vauxhall mokka over a year ago. Its been serviced but noted that there was squeaking coming from the engine and the front parking sensors were alarming for.No reason. Its been in vauxhall for nearly a month. Theyve changed 5 different parts between the same problem each time telling me its fixed. Its still currently in the garage. I dont want it back. If they cant fix problems with their own cars I dont want it. Im paying 320 a month for nothing at the moment. I want my money back where do I stand? And what shall I do?

I bought a Dacia Duster Laureate 4x4 early April. The first time I filled it with fuel, it stopped at around £40, although I knew it should have taken about £60. Thinking it was something I'd done, I waited until it required filling again. Same thing happened. I called my nearest dealership who advised I use a different filling station. This made no difference and I booked it in to have mechanics look at it. They advised they ran every conceivable test but could find nothing wrong. Said to try and fill it slowly! After 'clicking off' at around £40, I tried this and it did fill but took about 10-15 minutes and a lot of angry people queueing behind me. Went back to the dealership who looked again and said I needed a new fuel tank as there was a problem with the neck. They replaced it, but obviously never tested it, as the problem still exists. Dacia now stating it was probably a batch of faulty fuel tanks (twice!!?). It's now almost 3 weeks since I got it back and nobody has advised the next step. I keep having to call them. They have advised I cannot get either a refund or a replacement. Where do I stand on this?

My son bought me a car on finance last month,I traded in my old car and have changed my personal plate from the old car to the new one I have all the relevant documents from dvla ,I have been driving the car for weeks and today I got a call from the garage to say they want the car back as the finance have not handed the money over for the car due to errors on the garages part,I have paid out money on transferring plates,insurance etc.can they do this

I have purchased a new metallic white colour Mercedes E220. During transportation for delivery, the car rear bumper was damaged, which needs replacement and paint matching the car colour. Dealer has accepted their fault and are happy to get the bumper replaced and painted. But my concern is that it will be a repaired car, and not a new car any more. Painting done in factory is different than that done in the local body shops. What rights do I have in this case. Please advise.

Hi,
I ordered a Mk5 Mondeo and was given a delivery date which quickly past. Fords then said the car would arrive on the 30th May so they registerd it. It is now the 7th June and no sign of the car.
I am concerned that the car is loosing value even though it does not yet exist!
What are my rights and if I can cancel the order will I get my deposit back?

@maisy. It depends what the cause of the problem is. Usually at 5 months old (assuming not many miles have been covered at this stage either) most things that go wrong with a car are covered under the warranty. Vauxhall’s new vehicle warranty states the following: "The warranty ensures your peace of mind against material or manufacturing defect for three years (unlimited mileage for the first 12 months and subject to a total mileage limit of 60,000 miles from first registration). This applies to all cars and vans except Vivaro and New Movano, the additional warranty for which carries a limit of 100,000 miles from first registration. It guarantees repairing or replacement of parts and substituting parts for your new vehicle at no charge by a Vauxhall trained technician. To have a repair carried out on your vehicle, please take your service booklet containing your New Vehicle Warranty and Vauxhall International Service Certificate to a Vauxhall Retailer.
The warranty does not cover normal wear and tear or tyres and does not apply to: damage due to accidents, misuse or alteration, damage or corrosion caused by the environment, chemical treatments or aftermarket products, lubricants, fluids, third-party repairs, equipment on vehicles not built or supplied by Vauxhall or an affiliated company or to non-Vauxhall accessories. We recommend that the vehicle is maintained in line with Vauxhall published Service Schedules."

my daughter purchased a 1.2 corsa about 5mths ago and the salesman sold her a service plan with the car telling her any problems just find a Vauxhall garage take it in and say fix it and they will. mmmh problem is now the car after 5mths is smelling of petrol quite strong, so I told her to take the car in, she has called up to be told it might not be covered by the warranty so she may have to pay, am I right in thinking that at 5mths old the work should be sorted out free of charge as it comes under the consumer rights act that the car is not fit for the purpose it was bought for. she is 3mths pregnant and the smell is making her feel unwell everytime she drives it now. just need to know if she should pay.

Hi, I have purchased a new Car 21/05/15 on PCP and give a deposit of £200.00, I have also signed the contract. However, I felt that I was pressured into making a quick decision and hadn't research the market. @Janey_waney. Check the terms and conditions of the lease, but in general the delivery times on new dates do vary quite dramatically and there's not much you can do unless you were given a specific delivery date that has passed.

I ordered a new Golf GTD on a personal lease via telephone/online on 11 February and was told delivery would be around 14 weeks (mid to end May). To cut a long story short, I have just been told the delivery has been delayed until July and so I need to look at alternative arrangements as my current vehicle has to be returned next week and I cannot go that long without a car. I asked if I could cancel the Golf and was told I would have to pay a cancellation fee of 3 months' rental. I have not yet signed any kind of finance agreement or lease contract. Do I have the right to cancel without paying anything?

@maiaelle. You'd need to seek specific legal advice here we think. When you buy a car you usually check out the specification etc. Many modern cars do have auto levelling lights and unless you think they may not be working as they should (which is a possibility so be sure the dealer checks them out thoroughly for you), there's not much you can do.

We bought a new car in March 2015. On the day we brought it home we noticed swirl marks in the paintwork as if it had gone through a bad car wash. These marks are only visible in bright lights. We've had the car back twice to be buffed but the marks are still visible, maybe just a bit less noticible in light. However about 3 weeks ago a lighter colour started to show in the back passanger door. We have brought this to the attention of the garage and the head office who have now said it was a recaction between the paint and the lacquer. The head office just want to respray the door and buff the car again. We are not satisfied with this and have asked for the car to be replaced with a new one as this is what we paid for. They are refusing to do this. Could you please advise us where we stand? Are we not within our rights to request the car be replaced???

Hi, I have recently put a deposit on a used and approved car at ford which I did not see (I test drove the same model - I couldn't test drive the car I had put the deposit on as it was not there). The salesman told me to secure the car, in case it goes. A week later, the salesman rang and said it was the lower range model and that the only one left of what I wanted was more money. What are my rights? I want the car but do not feel like any of this was my fault as I put a deposit of a car that was not correct with the details they gave me.

@keasden. It is your responsibility to check over any bodywork etc when you accept a vehicle. However if you had to do anything out of the ordinary to check this (lying down for example) then that might be considered unreasonable. Can you take it to a garage/expert and ask them to assess how the damage might have been done and if possible when? Be sure to take plenty of photos as well. If you get anything conclusive from the garage/expert, then go back to the lease company and insist they add the details to the lease record. If you have difficulty try your local Citizen's Advice Bureau for further advice.

I took delivery of my new car last week which was purchased via a lease deal. The car was driven to me from the dealership and had 106 miles when it arrived. I had a look around the outside with the driver and then took him to the train station. When I got home I started to wash the car and then noticed a 3 inch scrape on the edge of a rear alloy wheel. The tyre sits proud of the rim of the wheel and is completely unmarked so it appears to me that it cannot have been done during driving of the car. I then found a very small scrape on the front alloy on the same side however the tyre over this mark is damaged with what appears to be a deep cut mark. I informed the lease company of this within an hour of taking delivery and today I spoke to the supplying dealer who's initial reaction is "we have a signed delivery note to say the car was received in good order" The damage can not be seen from eye level if the wheel is positioned so that it is at the bottom unless you get down on your hands and knees. I have sent them photos to try and show that I could not have caused the damage but they are not for budging. Where can I go from here?

I purchased the Mercedes Benz CLA 220 CDi AMG Sport on Saturday 21st February this year. Since I have picked the car up, I have had two problems which I am not pleased about.

First issue happened on Sunday 22nd March, exactly 4 weeks of having the car. The car had no power to it, it wouldn't go any higher than 1500 revs, almost like it had gone into limp mode. I contact the salesman who I contacted about purchasing the car in the first instance, to see what he thought it could be and he said I needed to bring it back in for them to look at. I brought it back to Mercedes Stratford for them to look at and do a diagnosis. You had the car for 2-3days to which I found the engineer could not find an fault and that everything seemed to be working fine. So I left it at that and I received the car back to which it seemed to be exactly the same as when I first picked it up.
Then, the second fault occurred on Wednesday 1st April, not long after I received the car back. I switched the car on at 8:15am as I was leaving for work to find an error message on the dashboard screen saying "Auxiliary Battery Malfunction". Once at work I contacted The salesman who said I would need to speak to customer care to get an engineer to look at the car asap. I phoned Mercedes Customer Care to book the car in for an engineer to look at, to which they told me the earlier date they could book the car in was "Tuesday 7th April". I told them I would need a courtesy car as I have got work to be getting to, then said the next date if I needed a car would be "Thursday 9th April. I told them I would contact Mercedes Stratford direct and look at booking it in as I was told to bring the car ASAP. Once speaking with The service department they told me I needed to bring the car in on ASAP, I brought the car into you on Friday 3rd April. Since you have had the car since 03/04/2015, the engineer contacted me 07/04/15 to say they couldn't find the fault and wanted to keep the car a little while longer to see if it comes on when they drive it. I was contacted on Friday 10th April to say that they wanted to keep the car still longer as they still haven't had the car fault on them.

While this has been happening, I was given various courtesy cars to which I was told they would be of the same like for like car I purchased or higher. 1) A Class A200 - given to us on Friday 3rd April, car was fine but below the class we purchased. 2) C Class Coupé - given to us on Tuesday 14th April, when my partner picked this up it had a gash in the tyre to which he went back in and was told it was legal to drive. However my partner had taken the car to a local tyre and MOT companies to be told it is Illegal to drive on a tyre like that and could be pulled over and given three points and/or even a fine for having a vehicle like this. My partner contacted Mercedes Benz Stratford regarding this issue to be told that they were sorry for this problem and for the inconvenience Someone would bring over a

@cheated. If you have expert evidence and it can be proved that the repair took place before you purchased the vehicle, then the dealer should accept this and take the necessary steps as advised previously. If they refuse to accept your evidence, then you may have take legal advice.

The dealership is now apparently looking into where this car was repaired, or if they have any records of this repair which all sounds a bit odd! So if they come back and say they have no records of the repair what on earth do I do?
I never would have dreamt of asking if it had been repaired when I bought this brandnew car. I just assumed a new car is what it is, or what it should be, new.

I bought a new car from a main agent dealership 12 months ago. I complained about the paint work from the beginning as it was easily marked, and also it's been back on numerous occasions with electronic faults. I have just found out from an approved body repair shop that my vehicle had sustained damage to the left side, and that I'd been sold a vehicle that had been damaged and repaired and not the new vehicle I had imagined. This is absolutely scandulous that a dealership owned by this car company could ever do such a thing. I would've never had gone near it if I'd known.
What are my rights?

@Mickeymoo. No this is an unusual mileage for a new car. You should have been informed (and given something to sign) if the car needed to be driven any distance. New cars are almost always delivered on a truck or transporter to the dealer, the only miles are usually due to the pre-delivery inspection (but shouldn't be more than 10 - 20 miles) - 300 miles would be unacceptable to us without advance warning. The stone chips would also be unacceptable although you say the dealer has remedied this. We suggest you ask for some compensation together with written proof of where/how the vehicle was used during those 300 miles.

Bought a brand new car on the 16thMarch 2015, when I went to pick it up it had nearly three hundred miles on the clock, salesman said it was taken up to Scotland to have leather seats put in, we requested leather seats but were not told it would be driven up and back. It also had chip marks on the body work. They have had it re-lacquered but it still isn't right, gone back to the garage today again. Not happy at all, a car costing £31,000 should be show room perfect.
Please advise our rights, our old car was taken in exchange and finance for six months ,then the balance to be paid in full.

I bought a brand new A45 AMG Mercedes 6 months ago, it's gone into limp over 50 times leaving no power! The car has broke down 3 times, the first time Mercedes roadside assistance solved 'throttle sensors' then the 2nd and 3rd time, the vehicle has been recovered and "repaired" I've done 13,000 miles in the car as I use it a lot for work! I have no faith in the car now whatsoever and I do not wish to take the car back (its currently with Mercedes) am I in my rights to request a full refund? (The car is leased) I've lodged a complaint with my finance company, awaiting an answer) Happy to get another Mercedes however not the A45 AMG!

Give them one more chance to repair and then tell them you would like a refund or replacement as you have now been put through sufficient inconvience. Note that any refund may only be partial as you've had 6 months trouble free use of the vehicle.

I bought a brand new Megane convertible in May 2014. Everything was fine for six months then the roof started leaking in Dec 14 and hasn't stopped leaking. It is yet again currently at the dealers due to another leak. The garage have advised they are struggling to fix the problem. This is a car on HP finance and I'm unsure where I stand. You've not mentioned what the electrical fault is but you have had the use of the vehicle for almost two years so the offer they've made for a new one also seems fair. You will need specialist legal help to fight this one.

I purchased a brand new Range Rover in March 2013 for £86,500. I complained a few weeks later about the full paintwork on the vehicle being faulty and the constant technical faults with the vehicle, VOSA even gave me 'off road' notification at a motorway check point, due to no tail lights!
22 months on, I am still fighting for my rights. I even contacted Standox, Land Rover approved paint manufacturer and they gave me a report stating the full paintwork is below satisfactory manufacturer standards. I contacted Land Rover direct and their solution was to repaint my car ( not an option for me as it will devalue the vehicle and I did not spend £ 86,500 on a vehicle to accept it being repainted). It also still has constant electronic faults. They then said ' pay £24,500 and we'll give you a new car. So how did they get to this figure? They value my car at £ 62, 000. They have applied the depreciation, despite it being THEIR FAULT resolving my issues. Does depreciation come into it when I complained a few weeks after receiving the car, the faults were present at point of sale and have fought for nearly 2 years for a response?

@prousey. It's best to insist that the dealer investigates the vehicle/repairs it again. See if you can check with the manufacturer as whether the information about the warning lights is correct (doesn't sound like it to us). If you are still not satisfied, and the vehicle is not performing as you would expect, then is the time to demand a replacement.

My Nissan X-Trail, Tenka top of the range, 64 Reg has only done 2000 miles and I had the problem of that the car would not start, I rang the dealership, Exeter, who said to ring the R.A.C, which said the battery had failed, the dealer replaced the battery and wiped the fault codes (12), but I am still having electrical problems with the car, warning lights appear, the dealer has said these yellow warning lights are a common problem and will go after approx. 50 starts later, I should not have to drive around until this happens will yellow warning lights flashing, this cant be right ?. The next step I will make is to return the car and ask for a new replacement one, or a total money refund, have I got the right to do this ?.

Hi, in July 2014 I bought a brand new car. It's Mazda 6 The car has been taken from Mazda dealer, Liverpool. It's still under warranty and its has only 13 000 miles. The car had a engine problem twice, since time I bought is. Second time (currently) is seriously problem with oil leaking and thick withe smoke in the cabin. @geoff. Was the original lead time stated in any documentation you received? If so, you will have a better chance of recouping any losses. Have you been given a plausible reason for the extended delay? Did you say anything at the time of delivery to indicate that you needed the vehicle for an 'essential' purpose? If you did, you have made the time essential and have the right to a refund or compensation. If you want to make time 'essential' write to the dealer and explain why and what you need the vehicle for. You will need to specify a deadline and indicate that once that deadline has passed, your agreement has been broken. If the vehicle is not delivered by the date you give, you can ask the dealer to refund you and/or ask for compensation because they've broken your agreement. You may also be able to claim compensation for the inconvenience.

@elsie. All new cars have paint/body work warranties. It could be a fault on this particular car. Take it back to your dealer, they'll be able to tell you what to do next. If you don't have any success with this, call the warranty company, then the finance company to see what they advise.

bought a new hyundai i20 3 door November 2014 from a hyundai dealer. Since it has got dirty I have noticed each rear wheel arch has a patch (like a plaster) on it matching the car colour. To me this seems like the body work is imperfect, not what i expect of a new car. The patches were not mentioned or pointed out when I bought the car. This is the first car I have ever boutght so would not knwow whether this is acceptable or not, however I feel cheated. It was dark when I received the car and I certainly did not notice any issues. It this usual, acceptabel and can I insist on an exchange car being provided now without these patches. I bought it through finance organisied by the dealer.

@john. According to the RAC a modern engine would generally be expected to last at least 100,000 miles. The Ford warranty terms/conditions state: " Parts and accessories fitted after the vehicle is delivered will be covered by a minimum 1 year/unlimited mileage warranty, but this may be longer for some items such as batteries." We expect the engine would be one of 'longer... items'. Go back to them and quote their warranty and the Sale of Goods Act (the engine has not been fit-for-purpose as it has not lasted the relevant length of time expected from a vehicle engine).

They fixed the two minor issues as expected, however I never expected these to fault at just 4 weeks. The noise / revurb saga continues. It's been a week now and no resolution. Today the garage informed me that two senior sales managers agree there is a noise and it is not normal, however the mechanics don't agree. I guess I am giving them the opportunity to sort the issue like you suggest and if there is no satisfactory outcome I think I will be sending a letter of rejection....unless there is any other advice?? I purchased a new skoda octavia vrs on 23rd Oct 2014, so 4 weeks ago now. I have an intermittent reverberation noise which can only be compared to that of driving with a sunroof or window open...except all windows are closed. It causes pressure on ears and is uncomfortable. I decided to persevere after informing the garage 2 weeks in. Then I lost power and the car went into limp mode. It's in the garage having a sensor fitted and fault on LED lights fixed. Needless to say I'm not very happy and what started out as great is becoming sour. What can I do? Ideally I want a full refund and hand the car back and cancel finance, is this possible? Needless to say the garage cannot detect the reverb! Any thoughts appreciated.

We purchased a brand new Polo from my local dealer. We collected the car, drove home and parked it up. In the morning I noticed clouding on the paint work. Took the car back and it was identified that six panels were cloudy. The dealer took pictures and said they would send them to VW and if given the authority would be looking to respray the car. We financed the car through VW Financial services. Is it acceptable to respray an brand new car. Any comments would be appreciated.

Hi all, just to update you, land rover replaced the gearbox on the vehicle but still doing the same thing, wrote a letter to the dealers advicing them of my rejection, also informed the finance company and they took the case seriously, i got a refund for every pound i paid the dealers. £300 towards the inconvenience caused and replacement hire car to use till we find and buy another means of transportation, which is collected now after two weeks as i bought another car.

@Carlos. The dealer has done a lot to try and rectify the problem. If it seems it cannot be fixed, you will need to examine the terms of your warranty to see what remedies are available to you. You have now been without the vehicle for over 6 weeks, which you may consider an unreasonable length of time. Have you been offered a courtesy car in that period? Having used the vehicle for over almost two years you cannot expect a replacement of a new vehicle, but you should write to the dealer and negotiate compensation sufficient to enable you to replace the vehicle either with a similar age vehicle or a new one (will have supplement any additional funds required for the latter).

Went to vauxhalll dealers, fell for a new Astra in white,signed the agreement and left a £500 deposit. Had a change of heart the next day andsent the salesman a email to cancel and visited him first thing on the Monday morning. He said "the car been ordered and can't be cancelled, the car will be delivered, then we can sort it out"..
That was on the 22/9/14. How do I stand on my consumer rights to get my deposit back.

Hi, bought a brand new range rover evoque and collected it on 12 july 2014, now the vehicle has gearbox fault that will make it jerks when drive or reverse selected. Roadside assistance came out and found a fault with the gearbox. Taken the vehicle back to land rover, still investgating the issue and they reckon it might need new gearbox. Mean while the vehicle has a built in iphone app or tracker, tracked the movement of the vehicle on friday 3rd of Oct and traced the car movement from the dealers site to a macdonald drive-thru then back to the dealer!
As a family we love the car and enjoyed it so much, but we feel let down by this issue and we dont feel its fit for the purpose as we travel around europe every summer.
Where do i stand in regards in rejecting the car or asking for a replacement new car and also about the technician taking it to mcds drive-thru pls?
Your help is much appreciated.

2 months ago I bought and paid for the new Jeep Cherokee only have 500 Miles twice now the engine warning lights came on and warning that the gear box needs servicing I just emailed the dealership with this problem and expecting to hear from them in the morning I would like to now what my rights are concerning the car I have no confidence in it now and I would like to know how to proceed with them do I have any rights to ask for a replacement car

@silky. Get a second opinion from an independent mechanic, then go back Peugeot. We don't have all the information but you should be able to drive a brand new car without any of these issues.

Hi, I bought a new Peugeot 308 on 1 Sept last year and have had a fault from the first two months. The car keeps stalling, it started while at a junction but then when I was turning corners. The garage have had my car in about 8 times for weeks at a time and cannot find the fault.
First they said it was stuck doing a regeneration and this time they say its a faulty fuel sensor.
I feel they are fobbing me off, being a women.
The service man did say I was driving a deisel car wrong!! I have had deisel cars for 20 years.
I have no faith in driving my car again as how I have avoided several accidents I don't know, especially when it stalled on a very busy roundabout. I am now frightened to drive it.
Can anyone help as to what to do?

@cascars. After 2 years rejecting the car now is going to be difficult. The car will probably have come with a 3 year warranty so be sure that you take action for any work that has not been done under the warranty. One would naturally expect a car to be 'fit for purpose' for far longer than two years, so it may be that you could have a case in the small claims court/civil court for any losses that you feel have not been justified.

I bought a brand new Chrysler 300c two years ago for £40k and have problems with it ever since. Neither the dealership, finance company nor Chrysler customer service have resolved these problems and I have been telling the finance company (who are owned by Chrysler) for 4 months that I wish to reject the car. Below is a copy of part of what I posted on the Chrysler Facebook page yesterday in an effort to get them to take notice:

I bought what was allegedly the very first one of the new model 300C two years ago. Since the day I bought it I have issue after issue with it, and despite spending around 40 separate days in the dealership most of the issues are still there. I have brakes that judder right through the steering due to warped discs, not for the first time, they have already been replaced once and 3 months later were doing it again. My sat nav can show me as many as 75 miles away from where I actually am, and despite being changed a couple of times is still doing it constantly. There are rattles from the centre of the dash and the sunroof, the rear visor has had to be replaced a couple of times, today it went in for a fuel leak from the filler pipe to be sorted as well as a major leak into the boot every time it rains. It has had to have a new Catalytic converter, new headlight, near high level brake light and new bluetooth module. The paint quality is terrible and even a finger nail is capable of scratching through to the primer! I cannot even trade it in as after paying 40k for it Chrysler then reduced the prices by 10k so I am now in negative equity to about 10k on the second hand value. The local dealership says that over £20k has been spent on trying to rectify warranty problems on it to date, yet there are still many outstanding problems that have never been resolved. One of the most annoying problems is the sat nav. I have now been told that this will not be fixed as Chrysler say it is down to 'Environmental' problems! I say that it is because it is rubbish! I am a chauffeur and having a reliable sat nav is essential to me. This one has already cost me an account with a multi-national company, and probably many thousands of pounds. The brake judder is embarrassing, and I now tell all of my customers when they mention it how Chrysler are refusing to put it right.

Where do I stand regarding rejecting this car?

I purchased a new Kia Soul last week. I have had back pain ever since and am unable to find a comfortable driving position. If the dealer cannot rectify this do I have the right to reject the car?

I'd appreciate any advice on this.

@bigpapa. Yes you have 14 days (cooling off period) in which to cancel the warranty.

what if and when you purchase a new car and you purchased a extended warranty and the next day you have decided to change your mine on the warranty because it was too exspensive in my mine.?.............can I change my mine about this ?.....or atleast moditfiy this policy with the dealer ?

@Rahi. Did you not check this before you signed for the vehicle? Either way if you can prove that the vehicle you purchased is not the one you originally viewed then you you can claim a refund (or the car you viewed). We imagine that proving this will be quite difficult unless you have some specific examples or photos.

Hi I saw a Vauxhall Astra GTC SRI on 28june. The car we saw, is not the car we signed for today. Some of the features are not there and also we have realized that the car is completely different on the inside.

I'm going to the dealers tomorrow to sort this out ... I either want the car I saw and am paying for or I want a full refund .. But what are my rights?

Any help is appreciated

I bought a 14 plate a Dacia Logan and paid an extra £300 for a media sat nav system. After 2 weeks of owning the vehicle I contacted Renault informing them that the Bluetooth on the media system keeps skipping when I try to play music. They diagnosed a fault on the system saying the software needs an upgrade but this will not be available until the end of this year. They will not replace or refund my money and say I must wait for the upgrade. I have gone through their complaints system who will not do anything as they say I have the facility to use USB or aux but this is not what I paid £300 for. I am considering going to a solicitor, can anyone advise how I stand on this.

I bought a new nissan qashqai from a main dealer in sunderland. After 7and a half weeks it developed a fault in the dash screen. All the sound from the media system (radio,cd,aux etc.) SATNAV keeps cuting out etc. The dealer have the car now after 4 days of testing they could not find the fault, they said nissan technichians will have to come and fix it but because they are in europe they do not know hoe long its going to be, they had the car for 17 days and still no answer. How long do i have to wait before i can demand a new replacment? TKS MARIO

I recently upgraded to fiat 500 lounge on finance, it drives horrible compared to my 500 pop and to me and several others feels faulty, stalls for no reason, revs without touching the accelerator. The garage are unable to fix that fault and have the attitude of tough. The vehicle has now come under a recall and needs the ECU replaced which I believe is the brain. I am so unhappy and want a new one, this one is only 2 months old, and I feel it is unsafe. What do I do?

I agreed a price to purchase a new car and when I got home I checked the Vehicle Order Form and found the agreed price at the main dealers was different to what I agreed by £1615. I have paid £300 deposit on a credit card and have E mailed the dealer to say I am not happy. If I can't get an agreement on the price I understood it to be what are my rights in getting back my £300 deposit.

I bought a brand new,dacia duster and have only had for one night because the alarm keeps going off. Garage can't find the problem (yet) and keeps asking for time to fix it. I have asked for a new car and they are saying no and they will fix this one. Can I demand a new car, its not financed and unpaid cash for it.

I purchased an new Audi TT from a main dealer on Sunday, paid £2k deposit there and then and was told the car was in Sherness docks in kent and would take a week to transport to the dealership.
All paper work was signed by both parties and deal done.
On Monday we were informed by the dealer taht the vehicle that we have purchased is no longer in Sherness docks and had gone.
The dealer then said they had an alternative TT in the same colour but higher specification we can buy.
Am i entitled to this replacement vehicle for the agreed price of the already purchsed vehicle.

Bought a new berina, there's a problem with the automatic transmission. The car can't get fixed as yet, but still can be driven. I find it unsafe to drive, as it jerks when I take off n feels like I'm being hit from the back!!
