Claiming Compensation Under Data Protection Act
You can claim compensation under the UK GDPR and Data Protection Act 2018 if an organisation's breach of data protection law meant that you suffered material or non-material damage. This is extreme, but if you have proof that it happened, it's a course worth considering. The burden of proof will lie with you of course, as you're bringing the action and though it should be relatively easy to find evidence of damage, distress can be a lot tougher to prove. It's always best to exhaust the other avenues first if you can.

Restrictions

Before you make a claim however, you have to distinguish between damage and distress - which can be a very tricky point and distress can be a very nebulous thing. Under the UK GDPR, you can claim compensation for non-material damage (including distress) without the restriction to special purposes. The special purposes exemption relates to different aspects of data protection law, not compensation claims.

How to Claim Compensation

If the organisation offers you compensation, then everything can be settled easily. If you can't reach an agreement however, you'll need to take them to court (although most organisations would prefer to pay a small amount than face the glare of bad publicity). You can either specify the amount of compensation you want the court to award you (known as "liquidated damages"), or leave the decision up to the judge ("unliquidated damages"). Your claim should also contain an application that demands the organisation remedy the breach in the Act that caused the damage in the first place.

Generally, if your claim is for less than £10,000, the court will allocate the case to the small claims track, which means you won't need to use a solicitor; you can handle the case yourself.

The Amount of Compensation

The amount of compensation is up to the judge; the Act offers no guidelines for compensation levels. This means he has to take a number of things into account, including the extent of the breach and its effect on you.

Even in the case of liquidated, or specified damages, where the sum you've stated is simply the same as the amount you've lost because of the organisation's actions, the judge might disallow part of your claim. He can also award you a lesser amount than you asked for, or possibly even nothing at all.

Getting Your Money

In most instances however, if an organisation is found to have done wrong and you've proved damage and distress, you'll receive at least some money in compensation and the organisation will pay relatively promptly.

If they don't however, or they refuse or can't pay, that leaves them in breach of the court. This means that you have to return to court to learn how you can enforce the judgement. This might even involve new proceedings, which can end up being more time-consuming than the amount is worth.

As an extreme measure, consider starting bankruptcy proceedings against the organisation if they refuse to pay. This course of action often achieves very quick results, but shouldn't be taken hastily.

I used to work for a training company but left after the under handed techniques they used to get rid of my husband, so I left went off sick gave notice. They gave me an advance before I knew I was leaving, i had to go into an iva in april at the time of leaving. They called my iva this month to say that I had an office. That has upset me because they had no right to ring iva directly surely that's a breach of GDpr. Can I sue them for that. Thanks guys

Both myself and my husband was involved in a non fault accident in 2016 ,we both went through separate claims for injury , my husband is ans has cohersely controlled all my finances, and has been financially as well as emotionally and physically abusing me since 2010, due to having no control of my finances I still live with him effectively I'm stuck. Last year he was arrested for injuring me like a fool I dropped all charges as he would lose his job he has a very good job working with vulnerable adults, anyway to get back to my story , I was paid my claim for the accident in Nov 2017, as .y situation is so bad I didn't tell him and used it to pay off 2 debts , his claim has still not been settled as he is fighting for more money , basically the claim solicitors breached data protection and told him my claim was settled , when it was settled and for how much, and he is absoloutey fuming, he has made my life hell since finding out and is demanding money , I have complained to the solicitors for doing this all they did was apologise , can anyone help as to what my rights are they have put me in a terrible position , thank you x

A social worker sent a letter to me but to the wrong address regarding adoption plans for my daughter. The letter was opened by the other household. Can i complain and get compensation. If so how do I go about doing it?

Me and my wife work in the same company. The company now requested the passport and nin to be resubmitted from my wife as they are switching to a different system. She joined the company 3 years ago and as she had her passport and nin scanned when she was employed, we think the company lost her file. The file contains passport, nin, address, phone number, etc. We are worried that the file may be found and used for various purposes. Do we have a claim on that basis?

Our solicitor emailed our mortgage information including debt and payments to someone we don't know. They then emailed the same person a week later instead if us . They didn't report the breach and after several days of us chasing and worrying we has to submit a second complaint to the partner who finally responded 24 hours after -1 week after our initial complaint and several chase emails that although we were her priority she had been on holiday and had only been back in the office 3 days. She confirmed the email address our financial and address and full names had been sent to was valid but it was too late she then offered us half of the legal fees we had paid her back and 12 months Equifax. We said no, so she upped it as a gesture of good will to the full refund if fees - this was on Friday but we felt we needed to discuss it with someone who could advise us like the ICO as our info was still out there. On Monday we told her we were discussing it with a specialist on the Tuesday as we had an appointment. Our appointment was 430pm . Wednesday morning after little time to think it discuss she gave us an ultimatum that if we didn't accept the offer would be withdrawn. So we felt we had no choice. Today she has demanded we agree to not contact the legal ombudsman or ICO and sign a letter to them effect before she will release the Equifax or oyr refund. Where do we stand legally here?

I have noticed on my wage slip that a Court Order has been taken off my wage. As far as I am aware I have no court order outstanding and have not signed a consent form. Is my company in breach of data protection as they have given my NI number for this payment to be taken and I don't know who has this information.

My ex employer has me still listed on the company's Meet The Team page, with info about my personal hobbies and achievements. I have asked him to remove it as I left in February but he responds to my email with a snide comment and still hasn't taken it down, despite the fact I can see new employees now on the page who started after I had left. He is seeking to gain revenue by using my experience to attract clients to his company. I am also featured in a promo video on their site for which I never signed a consent form and now wish to be disassociated with. What can I do please?

My ex-partner put my email address down as a secondary email account for a credit reporting company (Equifax) for HIS credit report many years ago. I recently had a query with my report on a different website (Clear Score) and raised the query with them. They informed me that Equifax would investigate and come back to me, however Equifax responded to my query addressing it to my ex-partner, providing him access to my entire financial history which I had not given permission for. There were things on my report that I did not want my ex-partner to know about and now he has seen it all. Not only did they send the information to him, they even addressed the email to his name! This has caused me lots of distress and worry. My ex-partner may have given his authorization for them to use my email address as a back up to his report, but under no circumstances have I given permission. My personal finance information is just that, personal and a company who is meant to advise you on ways of keeping this information safe to avoid identity fraud has just provided it to someone so easily. Even after responding to their emails stating that they had made an error, they continued to reply to the email address of my ex-partner with me just cc’d in on the email. Can I get compensation for this breach, it has caused me lots of stress and worry, let alone tarnished my reputation.

Eon, informed my old landlady of a outstanding dept i had with them ( that was for a old property i lived in) it caused me ALOT of stress abd worry and not only do the landlords know about it so do others as they have spread the word. Do i have a claim?

I booked a holiday with friends and the company kept trying to make me the lead organiser which I repeatedly refused and emailed to say they were individual accounts. Finally i explained the reason why was because on previous holidays I have had to chase a person for money and even paid myself and not been fully refunded. They then forwarded this email to the person and he was totally upset and has stopped talking to me. The company has chases and threatened him but he has not replied. They have copied me into their emails to him even though I have told them it is none of my business. They are now threatening to cancel all the holidays and keep nearly all of the money. Even though everyone else has paid in full and on time. Is this a breach of personal information and can we stop this occurring as it is their fault the animosity has happened.

I was recently included as a possible defendant in an employment tribunal although the pursuer and myself reached an agreement prior to proceedings..however it has come to light that the other defendant an aleo (of the company I work for) who employee our companies HR services passed the details via our HR to my employer..I now face a possible disciplinary process that may result in my dismissal do I have a case for breach of gdpr and possibly compensation.

Hello I called candy to register my warrenty for an appliance and during this registration I was asked if I was comfertable being contacted by third party companies I told them i was not comfortable and to not give my information out to anyone but then ten minutes after I got off the phone I had a phone call from a marketing company ontop of me asking them not to give my informatio out I asked them themselfs not to contact me via phone only to contact via email as I have anxiety and it can be verry distressing having unexpected phone calls after telling them this I feel violated and unable to trust them or anyone with my phone number do I have a case ?

I made a call to social services To report a child being hurt , first they gave my name out after I said I wanted to stay Anonymous 4 x times on the call . Then after this they gave out my full name and address three weeks after !!! They have offered me £250 compo but I have been under so much stress and fear for my safety now .

My comany was bought out via another company which I'm still working for. They have ask for all my personal information which my old company had. When questioned where all my information has gone I was told it has been lost and I must submit it all again. DBS. Insurance information ect. I'm very upset and worried to where this information had gone and what if it's fell in to the wrong hands. Where do I stand ?

A solicitor acting on my behalf with the CICA sent a highly sensitive medical report with historic and current information to neighbours property even though they had previously been told they had sent post to the wrong address. They want to offer me compensation but would like to know what is an acceptable amount?

A large insurance company is dealing with our landladys claim as our house flooded. We recently discovered that our landlady had a call from a police station and a folder had been handed in. In the folder was all the details of the claim including our address, where we work, the times we go to work and come home, pictures of our home with out contents in it, pictures of my car with my registration number, our mobile phone number, the fact we have foster children and their ages. Given the new GDPR legislation I am aware that this is a big problem for the company and that they could be fined. They are investigating the matter and have intimated that there will be compensation - my question is how much is a reasonable amount of compensation given the fact that they have basically given someone everything they would need to rob me? You should speak to a solicitor about how much compensation would be realistic. You would need to assess things like distress, time, inconvenience etc.

I recently had an ex girlfriend bothering me phoning me up calling round my parents a lot until finally I was forced to talk to her. I asked her how she found me and got my phone number, she told me she knows a member of staff at Oldham cash converters who knows me he told her to call into the shop where he logged into my account and gave her my details. Ive complained to the head office where I was told there would be an investigation I later phoned and was told he was having a dissaplinary then all I was told is that he is now leaving the company. How do I pursue compensation and how much do I pursue.

NHS lost my surgical procedure DVD and another professional within the hospital found it and gave to me by mistake. I later found that I did not consent for the procedure to be filmed. The hospital later apologised and acknowledged their negligence. I suffered psychological problems after watching that procedure as it was for my ectopic pregnancy. Can I make a claim?

Hi-I contacted social services to find out if there was any information they could provide on a case they were working on with my brother. I asked them to keep the conversation confidential to which they agreed. The social worker then told my brother that I had called them and told me that they were not aware of my request to keep the call confidential. I contacted the specific social worker again to complain and she apologised, then a week later used information we discussed in the second phone call as evidence in a family court, without my permission. I have raised a conplaint that was originally being dealt with informally, which I have declined and a formal investigation is underway.
What options do I have with regards to compensation and how much should I pursue if the authority accept they have been negligent and breached my confidentiality?

My husband is undergoing a series of tests at our local hospital and we have been sent personal details of different patients on TWO separate occasions. He is now very stressed as he is convinced that his data is not secure. We reported this to the PALs team who initially asked him to destroy all of the correspondence (an appointment letter & a procedure preparation prescription) which we have not done as we do not want to destroy any evidence. Should we contact the other parties involved and any recommendations?

Hi, I have just discovered that my local council has sent my annual council tax bill to my ex husbands address, disclosing my current address and my partners full name- I have been divorced for 7 years, after a very difficult divorce. He had no idea to my whereabouts, until now. The distress and anxiety this is now causing me is unbearable. Looking into the matter, I have discovered the local council in question has considerable history of data protection breaches. I have contacted a number of local solicitors in my area, who say they are unable to help with this matter. Do I have a case? If only to prevent someone going through this ordeal again and do I need a solicitor that specialises in data protection breach?

My children and I were moved to a safe house 100miles away from my abusive partner of 7years. He then fought through the family courts to try and gain access/contact with my children. The court ordered social services to carry out all sorts of reports on me, my children and their abuse father which is understandable. But then they contacted me accusing me or my family of passing our secret address on to our Abuser. After being accused of this for months and accusing me of emotional harm for allegedly doing this it came to light that intact social services themselves had past on th information. They had sent a copy of a report from the health visitor which clearly stated our info and whereabouts at the top of the report. Not only did it cause great distress the thought of him knowing our address they did absolutely nothing to move us as they were convinced it was me who had. I reported all their mid conduct to the complaint department only to be told that in fact they could not do anything or look into anything at the time as it may have affected the outcome of the court process......Ofcourse it would have, the court would find out what a bunch of incompetent idiots they were by sending our safe house address to our convicted abuser. Now courts over I’m wondering what can I do and what damages I can claim after suffering ptsd and continued abuse from the professionals that were supposed to help us?

Hi.

With regard to compensation, if the claim for compensation relates to stress and/or anxiety, the same threshold for personal injury claims applies so if the injury is valued at less than £1,000 then it will be tracked into the Small Claims track otherwise it will be Fast or Multi Track, which is just a slightly different way the case is progressed.

The government and the ABI (Assoc of British Insurers) would have you believe that a layperson can pursue a claim for compensation without the need for a solicitor, and I would have to agree that some claimants could do the claim themselves, however the majority of people would need some guidance and that it would be best practice to instruct a legal expert in this area. It is also very likely that your opponent will instruct a solicitor so to have equality of arms, it is advisable to use one yourself.

If you have concerns about funding, some solicitors will pursue your claim for you on a Conditional Fee basis (often referred to as a 'No Win No Fee' Agreement) which essentially means that they will defer payment until the case has been settled in your favour and will often pursue the legal charges from the Data Controller (or in this scenario, the losing party).

I recently contacted my mental health out of hours service in a suicidal state. When they returned my call I recognised the voice as my partners step mother so I panicked and hung up as I didn't want to talk to her about what was bothering me. Nearly an hour later someone else called me and I spoke to her believing that what was said in that conversation was private and confidential between me and her. The NHS have investigated "Elaine" (partners step mother) and I have since found out that the lady I spoke to worked on a mental health ward as a senior nurse in the same hospital as Elaine. 3 hours later Elaine re-accessed my psychiatric file and read the notes taken from the phone call in which I spoke to the senior nurse (which I believed was between me and her). The gentleman investigating has since told me Elaine spent over an hour reading my file. Her reason for this was that she would have do a hand over of my care the next morning, which has left me very confused as to why the senior nurse didn't hand my care over the following day having been the person that I spoke to therefore the person responsible for handing over my care. Elaine knew exactly who I was and when she made the initial phone call she withheld her name in an attempt to have me speak to her. This lady has always had an issue with me for what ever reason and knowing she is walking around with my most private thoughts has left me feeling very violated and vulnerable. I'm having nightmares and sleep paralysis as a result of the stress and distress. Myself and my partner have split up twice as a result and our relationship has suffered greatly.
It has taken the NHS 9 months to investigate but I still feel that I haven't had all the answers I need and want, this is such a long time for something like this to hang over me as an individual and as myself and my partners relationship. Is this worth putting in a claim for? If so any ideas what it might be worth?

Last year I purchased a cat from a local garage of which I had to pay cash as my credit had been damaged terribly (another nightmare). CAR broke down several times running into thousands of pounds to fix. Garage refused to fix brakes ect. I left a complaint online warning people of the dangers. This year the garage owner phoned me and threatened that if I did not remove it I could look out. Much to my horror he had replied to my comment online adding my full address and phone number. Having been moved for my own safety. My question is can he do this? Police said it's not an actual crime but may be breaking a data protection law.

The child services bury, went to see my daughters father and showed him all the reports for the conference.
My daughters father has no parental rights and his name isnt even on the birth certificate. The social worker even invited him to conference. She breached my data protection

In writing to me to advise I have underpaid tax for the past 3 years due to HICBC, HMRC have sent details of my salary for 3 tax years to an accountant I last used 15 years ago when I owned a company. In fact they have done it twice - I wrote back to them to dispute some amounts and asked them not to include the Accountancy firm in any response. They sent me the recalculations and, of course, included the accountant again. I have raised a complaint on their website but it's been 2 weeks now and no response. Any advice on what I should do next please?

I have been a patient at the Royal Free Hospital since 1998 for a serious liver condition. In this time I have been on several drug trials, some of which have been quite debilitating and as a consequence I have been suffering with chemical depression. As a very private person I was shocked and upset to find that the hospital I put my faith and trust in have given away my personal details and medical records to Deepmind a Google owned tech company. I am deeply distressed by this breach of my personal information. Can anyone advise me on what action I may take and what sort of compensation I should claim.

My bank has sent certified copies of my passport and child benefit letter to another customer. They have asked the customer to send the documents back along with a declaration to say they will not make any copies. My concern is that this issue can never be fully resolved. The other customer may have already made copies of my documents therefore signing the declaration doesn't really do much in terms of reassuring me. Where do I stand in terms of compensation?

The obvious thing to do is to inform your bank and get them to make sure your details are secure (this may mean changing your account etc but the bank should be able to help you). Write a letter to the HP company (get help from Citizens' Advice or a solicitor) explaining your situation and how this has compounded it. Ask for compensation if you think that will help.

You will need to consult a solicitor to find out whether a legal case for compensation exists. The information commissioner's role is simply to make sure companies uphold the law and take action against companies who breach it.

I went to a store and they asked for my postcode. When I enquired what it would be used for I was informed it would be used to determine the geographic area customers came from. I received an unsolicited catalogue from the firm today. They got my information through false pretences and used it in a way I would not have allowed if I'd known. I spoke to the data controller and he has admitted that a breach of the dpa has occurred. Can I claim for irritation and invasion of privacy in this instance?

Minutes from the outcome hearing of a dignity at work investigation were lost by the minute taker. Everything that was said was minuted and was highly confidential, personal and sensitive information. I did not get the opportunity to review the minutes before they were lost which was in hand written form. Is it worth making a claim and are there any time constraints.

I used to work for a company that issued fixed penalty notices for littering/dog fouling on behalf of our city council. A journalist requested ticket numbers issued from the company under the Foi act but the consonant mistakenly gave him a list of all employee names that issued the tickets. The company has sent a letter apologising for the mistake to me and has assured me that the journo won't publish my name but I am more concerned about the fact that the information was released in the first place. There are people/groups that have been set up verbally attacking personnel that do this job and I am more worried that these guys get the details. Can I claim compensation for the worries I am enduring?

I was waiting for the Housing Ombudsman to give me a decision,and send me a report. After a few days had passed, I contacted them to find out where my report was and I was told that It had been posted two weeks previously, but as I did not receive it they would email a copy to me. When I read my copy I noticed that they had got my address wrong and sent it to another neighbour who had been involved in this matter.
The ombudsman is now investigating this data breach, but who can I report The Housing ombudsman to, is it ICO. ?

Hi, Iv had an email from Dwp/parliament saying that my email I sent in December is one of the ones that have been breached.Id already put a complaint in about my treatment by the Dwp and assessor as the stress they caused me made me agoraphobic.Id already had a nervous breakdown and lost my job.So this was a complaint to them then and Iv got one in now, I won my appeal against the Dwp decision, the wait caused me more unnecessary stress.So when parliaments data was breached I'm assuming the issue that was on the news? They sent an email apologising and saying they don't know if it will be used or not.Not exactly that wording.They had caused me enough stress, now someone? Has my personal information as it's in the complaint.Im not happy with them already, let alone this.What are my options? They have admitted it in the email and don't even know who has it.

Question - my doctors gp have sent a letter to my sister in law containing my medical records from hospital that they should of sent to me. I can't understand how they could do this when on the letter it states my name address and dob but they still manage to sent it to my sister in law. Can I do anything about this?

Hello all. Now guess what.
My current insurance company cancelled my insurance, we recieved a card from the post man to notify us (my girlffriend and me ) he been here to hand a letter which requires a signature. We weren't expecting a parcel for sure firstly and secondly they sent us a letter which needed a sign. Fine. They never called us to follow up with the no claims discount which I had requested from my previous insurance company. Now the part that makes me frustrated, while I'm trying my best for my current insurance policy not to be cancelled the manager does not sympathise and says I will need to call your insurance company to check if this is correct ! He also says once we have confirmation that this no claims certificate is good he will then have to put me on a new policy. Which means I'm loosing out on my no claims discount and having to take out another insurance policy which i can't afford to as these insurance prices are sky high. So he makes a call to my last insurance company and calls me back saying they wouldn't confirm this with me as I'm in debt with them. Now when I rang up the insurance company that same day they never told me anything about a debt. Didn't send me no letters seeking payment of any sort. Is this a breach ? Thanks in advance

Make a complaint to the company, ask them what their policy is regarding people at the same address etc. If necessary report them to the Information Commissioner

I recently set up a payment plan with a debt collection agency. my partner also set up a payment plan (completely different account and not linked to me in any way). However when he spoke to them to set up his payment plan and they wanted to send email confirmation they advised him that I also had a plan set up with them and they would use my email to send confirmation. At no point had I given them permission to discuss this with my partner (I actually hadn't told him I had a debt that I was repaying). He now knows and I didn't want him too. what should I do as I expected my information to remain confidential now my partner knows I have run up a debt and is not overly happy with me for not telling him. - would this count as distress caused.

The job of the ICO is to prevent this kind of thing, so on contacting them they will take action to ensure the company acts within the legislation. If you want to seek damages/compensation etc for you losses, you will need to do via the courts.

Hi,
We went to furniture village over a year ago to purchase a mattress. We paid for it and was given a receipt. We had drone problems with the mattress and when I got the receipt out I noticed a name,phone number and address on it that wasn't ours. After a bit of a nightmare regarding the mattress they agreed to a reselection so we ordered another mattress and were given another invoice. I had to call the shop regarding the uplift of my old mattress, and when the guy put my details in he said my name address and phone number was on thousands of invoices!!! I then started receiving phone calls from people assuming I was furniture village. I contacted them and they just ignored me so I directed it to the ico who have told me they have co tacked them and informed them of the breach and actions they need to take to prevent it. I feel that this is not going to help they flouted dpa and we're not bothered. They put my family at risk and causes us so much stress and it feels like nothing has been done

Can I please ask if the ICO has indeed found the local government body to be in breach of the DPA and you've been issued with the final letter etc. Should you decide to start court proceedings but cannot afford a solicitor do you use the form N1?

Firstly complain to the NISCC so they are aware of this error on their system and can amend it before it affects someone else. Secondly raise your concerns with the Information Comissioner Here , thirdly, if you want financial compensation, it might be worth contact a solicitor.

Hi I am currently in the process of applying to NISCC in Northern Ireland to be placed on their system as a Registered Support Worker as per the legal requirements set out by law which states all Care workers should now be officially registered. I began the application then saved my progress to complete at a later date. when I returned to the NISCC website and logged in with the same details I have now found that my details are merged with another persons of the same name. I am able to see his employment history and sensitive information such as his dismissal from a previous employment and reasons for this.This is obviously a breech of Data Protection so where do I stand now in regards to legal action? Insurance companies are normally very scrupulous about speaking only to the policy holder. You should make a formal complaint to the company. If you want compensation mention this in your complaint. Then consider the courts or the financil ombudsman. It's definitely worth thinking about changing your insurer for subsequent years.

Mu ex husband was able to insure a car 2 yeara ago on my insurance policy even though we had split 6 months earlier, i had no idea of this untill i receive a letter from my insurance company regarding a payment for it, i was angry with the company and told them under no circumstance should my policiy be used by anyone else amd was assured it would be placed on file .... then the same company took a payment from my personal bank account for my ex husbands insurance policy just 5 months ago amd now just 2 daya ago my ex husband rung my insurance company amd was given details regarding my car policy and my payments, having spoken to the company today they were very blasé about it and said they didnt notice it was slapped all over the screen not to allow anyone other then myself access to my policy details, now ex saying he not giving me one weeks child money as im saving 80 on my car insurance the next 2 months, where do i stand with this as surely its a massive breech by the company

Received a call from IKEA regarding my faulty sofa, only the sofa which I bought was at my exs house (messy end to the relationship) he had managed to get another girl to phone ikea pretending to be me and use my data information to get a replacement sofa! Ikea phoned me as I was the card holder and my information is on their books, only to not know anything about it!! So not only did my ex cause fraud, IKEA allowed someone to use my account!! Just after 3 pm made a purchase of 2 pairs of shoes, treatment spray and forgot to take card from payment terminal.. telephoned shortly after and asked if card was there. Was greatly relieved when told it was .. said be at the store before closing or if missed would be in the next morning. Staff told me that unable to hold overnight .. After certain amount of pleading from myself it was agreed that my card would be held in secure place overnight if needed. I decided to change my plans and go and get my card. ... but when I got there the other member of staff had cut my card up and thrown pieces in with their rubbish .... I was shocked, furious and extremely concerned for security of my cut up card and I needed card over on coming days for major purchases. The outcome was spoke to area manager and rule was cards to be securely cut after 24 hours .... a little different from the 3 hours max I had from purchase to my store return ... company sympathetic and offered goodwill gesture and my cut up card retrieved from the rubbish .... I am angry and without access to card for over week. What should I do ?

Hi, I took my PC to be repaired (it was under 1yr old and under warranty) at John Lewis, I then paid for them to take a back up of my data as a precaution. Finally after nearly 7 months?! John Lewis decided to refund me minus depreciation as the PC was not able to be repaired, I've gone to collect my data and all has been wiped. It was 196gb of photos and videos of my children, taken over 10 years. They have simply apologised. Where do I take this next, I don't think an apology is adequate. Many thanks Lisa

My local Law Centre are representing me at a DWP ESA Appeal tribunal.

I was waiting for them to send me a copy of the DWP medical assessment and the DWP appeal documents.

This morning, one of my neighbour put a transparent plastic bag through my letterbox, with a sticky label attached saying "Opened by mistake - Mike No 9".

Inside the bag was an envelope, with my name at the top but addressed to No 9 my neighbours house.

Inside the envelope, was my medical assessment and the DWP ESA appeal tribunal documents.

My medical condition is a serious illness, with the extremely embarrassing consequence of 'severe double incontinence'.

Now not only do the resident of No 9 know but soon enough, the gossip will spear to my other neighbours.

I rang the Law Centre, to inform them of this major breach and the solicitor responsible responded with a apathetic "Sorry about that", when I asked what will be done to ensure my data is not breached again, I was given a flippant "I'll just have to be more careful in future".

1. My financial circumstances and income data has been breached and disclosed to my neighbours, as they now know I am an ESA claimant

2. My very serious and highly embarrassing medical condition data has been breached and disclosed to my neighbours, in documents that not only detail my current medical status but also my medical 'History and treatment'

3. My legal affairs, regarding my appeal tribunal data has also been breached and disclosed to my neighbours

4. Unlike disclosures from one organisation to another, which is contained behind their walls and doors - the disclosure to my neighbours, as I have lived here 17 years, I know my neighbours well enough to know this will be the subject of gossip and embarrassment that I will not be able to escape. I see my neighbours everyday and I will have to feel the embarrassment every time I see them, for however many years.

5. Only my Mother knows the full details of my condition, as she is my next of kin, so she knows I almost died and I have undergone several major surgeries. NO OTHER relative or friend knows the full extent of my medical condition i.e. severe double incontinence; as as I stay home the majority of the time, as my condition makes it too difficult to go out and I discourage visitors also. Therefore, I had kept the details of my medical condition totally private and now all my neighbours know.

I cannot see how there would be financial damages in this situation, however, I am sure it is clear I am and will continue to experience extreme distress, that is inescapable, as it is at my home where I live everyday, every time I see my neighbours.

I would like to make sure the solicitors and his employers are made to treat this seriously and acknowledge it it not acceptable and they can't just shrug their shoulders.

Can you advise me whether you think I would have a claim for compensation?

You will need to check whether his name is still on the rent agreement or the existing information you gave etc. It doesn't sound like an error that is all of the council's making.

My ex recieved a letter at my address fron the local council which i passed on when he opened this it contained my bank details regarding my durect debit for my rent agreement, my ex had moved out in 2010? Am i entitled to claim compensation.

Hi. I told my employer I had a mental health diagnosis but I was incorrect.

They then told my children's social worker who went onto tell my ex husband and he never returned them to me after contact.

My employer has destroyed my children's and my lives as I am now in the famply court fighting to get them back.

Any advice would be much appreciated please.

My partner recently found out that a very confidential letter had been sent to another address. The said letter was from social services regarding minutes from a meeting and had lots of confidential information. The police have retrieved the letter now from the wrong address but who it was posted to knows a lot more than they should and have taken pictures of the letter.
Any advice would be appreciated as Social services have just uttered a 'Sorry!!'

hi. I been renting a flat with my partner for more than one year. we decide to broke up and we move out. I dont want to keep in touch with my ex now and dont want him to know my new home address as it dangerous person for me. now i received email from agency with check out details which been made only by my self and clerk. email sended by agency include my new home address. same email been send by agency also to my ex including my new address.

Hi, I am currently in the process of purchasing a property and i'm experiencing all the pleasures of dealing with property solicitors. In my dealings with them they have had my address down wrong on their system and sending all the details of my purchase to a wrong address (even though the application form I filled out had my correct address on when I signed to use their service) not only this but when I have phoned to make an enquiry on my case I have always passed data protection even though the address was different (this to me shows a clear failure on their part) what would be my next steps to making a complaint? would this be due cause for compensation?

Hi. I work for a reputable supermarket and have done for 5 years. I have been promotes to manager and needed my personell file sending to my new shop. That file had all my right to work, (passport pic/details, driving licence,NI number, bank details etc) so upon them sending its gone missing nowhere to be found not sent recorded delivery so no way of tracking it. I worry constantly to the point of having to change my bank details and cancel my passport. But now work want me to purchase all these things again thats money i dont have. What can i do as i have to get a passport (£80) driving licence £40 total cost is around £200 and then its all my personal details thats gone too. Please advise me what i can do

After a messy divorce I was in a position where I had to make a claim housing benefit. The local council, quite rightly made a decision after a year or so to check my claim. During this investigation my bank provided information regarding all accounts, current, savings etc. However the information provided was not mine and was in a name not even similar to mine and also 300 miles away. This information however was used to take me to court for falsely claiming the benefit. The court quite rightly dismissed the claim after 3 attempts of a case hearing due to me contesting the information. But due to the nature of the case the council stopped the benefit and also has made me payback all the monies received. (Apparently a classic move even after being found not guilty) the amount was around £7000 also I had to pay solicitors cost etc. Is there a case for me to claim compensation from my building society as this has obviously put me in financial difficulties and has spiralled me into debt just to pay standard bills etc.

You should have reported the initial accident and the following abuse to the police. It's common (and in some cases compulsory for addresses and contact details to be exchanged in an accident), so it's unlikely suing your insurer would be succcessful. Please contact the police and inform them of this series of events.

A drunk man crashed into my parked car 3 times and tried to drive off. Neighbours saw him and stopped him, but he was verbally abusive and intimidated them and walked off into the pub across the road. I took pictures of the damage and contacted my insurance company as he wouldn't give me his name when I arrived at the scene. My insurance company agreed I had a claim against him and contacted his insurance company who send him a letter of a claim made against him which also had my personal details on as well as my address. The man who crashed into my parked car used my address that his insurance company gave to him to turn up at my house with another man to threaten me and give me 24 hours to drop the claim. I am a single mother and now he keeps on harassing me. I am so frightened to leave my house in case he's outside which is causing me great stress and I am also very angry at the insurance company for giving him my address which they said they are sorry for it was an error and they won't do it again but it is too late the man has sat outside my house and is harassing me to drop the claim. Can you give me any advice as I want to sue the insurance company for the distress I am still going through because of them giving the man who crashed into my parked car my personal details?

You should see a solicitor if you want to take further action. This sounds a bit strange: (1) that you wrote and your address was not changed - most reputable lenders are efficient enough to cope with this (2) that you old neighbours did not simply return the post to its sender (3) that you did not have your post forwarded to your new address by the post office, or inform the new owners of your new address.

I had a loan with a well known high street bank which completed in 2010. For some reason, the final £80 payment was returned to my bank so the loan remained unsettled. Around the same time, we moved house and our mortgage at the new property was with the same lender which held the loan. We informed all parties of our change of address but the lender didn't change our address on their system. Despite them also holding our mortgage, they continued to write to our old address demanding the £80 and threatening legal action. I only became aware of this after struggling to get another loan and obtained my credit file to see what the problem was. The high street bank had put a default against us for the last 6 years and it was still showing. I contacted my old address who said they knew all about the payment and potential action the bank were threatening. They had my loan details in its entirety but couldn't forward as did not have our new address. Have I got a claim for data protection breach please?

Hi, I am currently going through an injury claim due to being dismissed last year I appealed and got my gob back, all my medical and sensitive information were sent back to the department with just a room number and were placed in a third party's hands, I received an email at 4pm from a manager saying he had just recieved some papers with my name on it and will lock them away, only thing is when I did some digging the papers were recieved in this room at 9am so where have they been for all that time, any advise would be great

Can I ask some advice please?
My partner used my phone to contact the automated system at work, there is an option to say whether this is the number to contact you on which he chose no. They continued to contact me even after my partner returned to work, when they did not have permission to use my number as his point of contact. They then handed my number out to another company as his point of contact. The stress they created for me was unbelievable (waking my sleeping son) They are claiming this is not a breach of the Data Protection Act but I feel it is?

I was in my previous job for 10 years until I was suspended for 9 months with full pay whilst an investigation was completed regarding safeguarding issues against children, police investigation completed with no further action, My mental health suffered severely due to the distress of the situation.
Staff members outside my home and my mental health shared in a meeting without my consent, I was sent minutes of the meeting where I read my mental health issues including a suicide attempt, I was struggling with the way the suspension was going and could not see a way forward, I put everything into my job, I was dismissed at the end of the suspension for reasons I fully disagreed with, I appealed but felt the company was to clicky and wanted rid of me as I had previously followed the whistle blowing procedure.
From start to finish I felt completely invaded.

You should seek professional legal advice on this as we don't have enough information. Did you acutally ask the staff at the wholesaler to keep the information confidential? Does your employer have a clause about operating a competitive business etc?

Hi, I worked for an business and am planning to open a similar business in another area close to home. We opened an account at the wholesale in my partners name as the business will be in his name. A member of staff at the wholesalers has given this information to my employer together with the address I believe, and I have now been fired. I have complained to the wholesaler but they are unwilling to pay compensation for my loss of earnings. Any advice please

Hi, a landlord called the council on my behalf asking for my pay dates of housing benefit. At this time I had served a request for the landlords details so no rent was legally collect able. I did this as I didn't believe the agent had been instructed by the landlord to collect rent. The council had no details of the new agent and I had not given them any details to say the agent had changed hands. Dispite of this the council gave out my payment dates to an agent that I had no history with. I know this to be fact as the agent sent an email to me stating the council had given him my payment dates. I have contacted the council and they have said that there has not been a breech of data protection and no information was given out! Where do I go from here as I want the council to acknowledge there mistake.

I was recently victim of sim swap fraud. I believe my mobile company and possibly my bank has breached the Data protection act and allowed criminals to obtain my phone number(sim swapped to another device)by calling in pretending to be me, somehow getting past the 'security' questions and asking for the switch. They performed the switch and I believe if I hadn't immediately noticed the lost connection they would have had time to empty my bank account by authorising the transfer to another account. I want to know what exact parts of the Act have been breached and if I am entitled to compensation. I should note that the hackers had requested and had approved a £3000 loan which was in my bank account. So aside from my own actual money they would have removed this fraudulent 'loan' as well.

Hi I was a victim of domestic violence including my children it has taken me 11years to escape him been one of the hardest things I have had to do in my life. I have been in and out of court for 2 years trying to sort this problem out I have succeeded BUT social services didn't retract my children school location and the area where I live even though there is high risk involved and gave our information to the offender. Clearly this is a breach our rights especially when there is non-molstation. I have had to pay £16000 in legal fees to get this man away from me and my family and they just gave him our details this has put us in huge danger as he has mental health issues and a huge criminal history. I live in fear and cannot go any wear on my own now this has ruined my life I have to move because of this and this will cost me again. Why should I pay anymore for there careless mistakes. They should be made to pay my entire legal cost as they has wiped out all my progress and our safety. He has been stalking us messaging family members with violent content. The worse part is he the fear and the effect it has on my oldest child and that understand what is going on and everything that has happened .There has been serious allegations of abuse they didn't even deal with but then again I'm not surprised with all the things I hear on the news now. The youngest is starting to mention things that it witnessed towards the eldest. Sorry didn't give names of children I'm just always vary because what has happened to us.

My children were recently subject to a social services report, social services closed the case a few months ago but called me yesterday apologising because they has accidentally sent the closure record which contains all the details of the case including police, mental and health reports to my neighbour, said neighbour opened and read the report before calling social services to tell them they had sent it to the wrong address! I live in a very small and close knit village and word gets around very quickly!

I attended the police station to report being stalked by a man known to me. The officer found my account implausible and disclosed my personal information to Social Services despite my repeated refusal of consent.
I was not known to Social Services, but they found out who my GP was by unlawfully accessing the SCR and then passed the information to my GP without my knowledge or consent. The GP then referred me for a mental health assessment despite my refusal of consent.
I complained to the police re breach of DPA. In investigating the complaint, police contacted my former work colleague without my knowledge or consent and obtained information about my health and personal life. My former colleague gave no indication that I had a mental illness (because I don't) but the police rejected my complaint on the grounds that they had 'diagnosed' a "mental health condition" and the disclosure was in my 'best interests' (which is again an unlawful decision).
I also complained to my former workplace re breach of DPA as my former colleague had disclosed my confidential information to the police without my consent. She denied disclosing this information, despite it being recorded in the police file.
I also complained to the GP re breach of DPA. It went to the Ombudsman who concluded that I HAD refused consent (contrary to the GP's claims), but the GP had "misunderstood" (despite my repeating my refusal more than a dozen times) and no restorative action was recommended. Furthermore, the GP had also written in my records that I had a history of mental illness when I do not. I have asked the surgery to correct my records (or explain this diagnosis) but they continue to ignore my request. The GMC and NHS England have both tried and failed to secure a response from the surgery.

Have you been paying the landlord for your energy usage? What does your tenancy agreement say about paying for your energy? This could be the necessary paperwork you require to prove that the bills shouldn't be in your name? You might want to take all your paperwork to the Citizens' Advice Bureau for individual help.

My land lord owed big amount of money to one of the energy supplier. I am tenant without my knowledge she transferred the properties energy bill under my name and landlord had a deal with the particular company. After that the energy company start to write to me I have to pay my energy bills, I spoke to them they are always neglecting me to respond proper way they put me on hold some time more than half an hour on hold. I am so distressed because of this the land lord even not taking this as a serious issue finally I am thinking to take a legal action against my land lord and company could you advise me regarding this big headache please!

I have h lots of problems with my local council breaching my confidentiality and making my life a living hell the last ten years. In an unrelated incident I received a with my address but a different name. It was highly confidential concerning a child protection case conference but to someone else. They have got my address down but for someone else. My question is what should I do? It has a date for these people to attend a conference so they should know about it but I have such a bad relationship with the council I don't want to even speak to them to alert them to their breach

I have had my drb disclosed by social services to third parties, such as school heads, teachers and others. one of them has told other people beyond that. I have not given permission, I am only a friend of the mother involved with social services and have nothing to do with the third parties.
is this a breach of laws and what can I do about it.

I recently apply for housing benefit and council tax from my local authority.
I filled in all my details and new address.Despite this the council sent confidential letter on progress to my old landlord who in turn started calling me accusing me of applying for benefit on his house even after I left there more than 4 years ago.I am really distressed about this because we are from the same local community and has now told most people about it.I feel I have been let down by council about this for not updating their record about me.
Also they have let me down by letting my old landlord know about my present financial situation.I need your advice on way forward to suing the council about this, Thanks.

My employer breached the DPA on many occasions with regards to medical data. The ICO found them guilty of numerous breaches and my attempts to rectify the situation with my employer over the last year have been unsuccessful as they will not even follow their own company policy of dealing with it. It resulted in me having to move work place as people found out about a medical condition. What time limits do I have to make a claim with regards to reimbursement of solicitors fees paid and compensation for the distress which has affected my health?

I have had major problems With BUCKS COUNTY COUNCIL they

I spoke to Nationwide over the phone to change my mortgage payment direct debit to my new nationwide account (was with a different bank previously), to which they obliged. I've checked my balance today and noticed a payment to a mortgage account that isn't mine (it has the other gents name, mortgage number etc). Spoke to Nationwide who've said they made a mistake, but this guy now has my name, sort code and account number. Plus I need to wait for nationwide go get my money back off him. Where do I stand?

Hi. Last year we purchased a property with a Notice of Potential Liability (due to solicitor's mistake) and have been in dispute with the solicitors since trying to get it discharged. It was agreed that they would cover the debt once they receive the final figure from the factors.
The factors and solicitors representing them have been very unhelpful in this matter - we spent multiple hours trying to get them to cooperate with our former solicitors.
Recently, the factor's solicitors registered a NEW Notice of Potential Liability relating to "outstanding charges since our move" - this was done in error as we are fully up to date with the billing. So not only they falsely registered a new NOPL against our property without our knowledge (despite being in touch on a regular basis), they disclosed this false info to the third party (our former solicitors) which can now hinder our negotiation with them.
I believe this is a breach of the Data Protection Act on multiple levels and would appreciate your opinion on whether we have a case. Thanks.

My partners credit file had his dads information on it giving him a very poor credit rating. He informed the bank who admitted they had made an error. We were denied any mortgage lending and are currently sleeping in a family members spare room as a result . It has taken the bank 6months to remove the incorrect details from his file. However we have missed out on buying properties in the meantime. The stress and strain this has caused is unreal nevermind the time consumed trying to correct it. The bank are considering their response to this but i think we should take it further as they have put our life on hold for 6 months. Is this worth persuing?

Hi I had cause to request confirmation of my resignation as I has been informed that my ex-employer's reason for leaving did not tally with my application for a new job My ex-employer stated to me also that resignation was not recognised and offered alternatives. I then instructed a solicitor to resolve this and it was to a degree resolved, however it cost me dear to change the ex-employers mind. Can I claim the solicitors costs in the small claims court?

It's difficult one as your neighbour was involved and went with you to arrange the funeral. The funeral director may understandably have assumed that she/he was helping you deal with your affairs. Unfortunately, they will require payment and it could be difficult to refuse on the basis that you feel your privacy has been compromised. If you are experiencing financial difficulties, there are lots organisations that can help, such as Citizens' Advice or the Money Advice Service.

My husband died in January this year I took on a funeral director paid the first part but got so distressed I shut myself of for a couple of months I got a couple of letters from them asking for payment. They then got in contact with my neighbour who lived 2 doors away who helped me with the first sitting arranging the funeral. Then they got a solicitor to physically go to her house and told them what's happening and how much I owe!!!! They then contacted me by email and was VERY nasty.I told them they had breached data protection but they said couldn't care less

My son attends a Disability day centre, and I had an assessment with them for services and she said her friend a Social worker knew me and was my ex social worker.
A social worker then took it upon herself took a file from work and gave it to this worker to help with my assessment
I was horrified it had all private information in it about everything.my children.health.finances etc.
She aquired me a support worker who then on picking up my son gave me his day file with this assessment in.
She had let this support worker read all my private information and the support worker said it was just in the office free for all to read.
I'm so embarressed and humiliated and angry.

Can anyone advise me on the following scenario - in 2012 my bank details we used by a family member to set up a monthly DD at a local gym without my consent. Upon discovering (after 5 months) I cancelled immediately and my bank reimbursed me and pursued the gym. I have just discovered that the gym has yet again taken over £500 from my account over a period of time this year, they have admitted an administration error as had transferred my details to a new system that automatically took payments, the family member did not give authority. My bank have yet again reimbursed me, however, I'm furious with the gym managers attitude and lack of empathy and only his 'personal' assurance that it will not happen again (exactly what I was told 3 years ago) How should I pursue this?

A well known car rental company have my full name and address details on a car rental agreement (August 2015) for a car that I never rented myself. I have only just discovered this as I received a parking fine notice for the rental car. On appealing the notice I was told (and send correspondence from the rental company) showing the agreement in my name.The agreement has a signature on it but it's not mine!

Would I have a case? They are looking into this at present but I see this as a clear breach of data protection since some complete strange now has my full details!

You may well have a case, but this was just the result of someone acting irresponsibly, albeit with the right intentions. What would you hope to win from taking this further? As long as you have made the supermarket aware that in future this should not happen we're sure this will suffice.

A stranger found my lost car keys and went to hand them in at a well known super market. Instead of taking the keys and looking after them, a supermarket employee gave the stranger my full name, address and postcode and gave my keys back to them and let them walk away with them in hand. I was lucky that the person who found my keys had good intentions, but my personal information should have not been shared with anybody, as they could have been dishonest. This obviously put my car and house at risk (my house key was attached to the car keys). Do I have a possible case?

You would need to seek legal advice. Some grants are not given without medical evidence so even if you'd given your permission, your doctor would still have given the council the information.

I am currently having problems with my local doctors who gave out my basic medical documents to the country council without my permission.
This has caused the council to Cancel a new ramp fitting into my home enabling me to get access with my wheelchair in and out of the house independently, at a cost of over £5,000.
The council also sent me a letter giving me my recent blood reports for an allergy (before the doctors told me), the allergy is not related what-so-ever to my spinal injury (hence in a wheelchair).
I am also having to move into a home with easy access (unlike my current one).
Do I have any sort of case against either the Doctors or the Council (for asking for documents which they should have asked permission for first)?

I HAD A BAD FALL ON MY PATH AFTER REPOTING IT WAS UNSAFE AS IM DISABLEDMY SOLICITOR SENT FOR S/SEVICES AND MEDICAL RECORDS! with my permission but she messed up my case and I got my files!! I HAD ANOTHER LADY I DO NOT KNOW and the doctor didn't care he just said COMPUTER ERROR!! then I looked at my adult social services file and I was amazed distressed at how these people can lie!! they put a place I had NEVER lived-said my son passed away the wrong year and how he had passed away DIFFERENT to how he had!! they said I HAD ASKED TO GO IN REPITE CARE I distrust any nursing home ive seen first hand how my father was treated-I NEVER EVER ASKED TO GO INTO A RESPITE CARE?? the liesgo on a doctor examined me said I had a blood clot throught the fall but said I could weight bare??? I never got out of my wheelchair I coud not it took two people to get me from the bed to my wheelchair but even though ive told him he wont alter the untruth im disguted these are the people that supposed to care for us?? trust THEM NOT ME KEEP THEM OUT O YOUR LIFE AS ITS JUST WHAT THEY WANT TO PUT ON FILE ---NOW THE DR IS TRYING TO SAY IVE MEMORY LOSS? welcome any emails on this

In december i had a baby in hospital. A member of staff from compass/medirest informed my ex partner i was in. She new i had no contact with him for 7months prior as he was abusive. Ive been told by her boss thats its been delbt with but will not tell me the outcome because of her confidentiality. I no shes still working there..medirest is a company that is hired by the nhs for meals,drinks etc

Could any one offer some advice, I fled domestic violence a year ago being placed in a safe house with my two young children all our details doctors hospital always come up as a secure address on any system although some weeks ago my ex partner telephone called the healthvisiting team and they gave him are secure address. Me and they children had hrs to flee the address being put many miles away in a refuge until a risk assessment was done again. A week later I returnd back to the address having to gather more things for the children and my ex partner turned up I had to call the police through fear of harm or worse to me or the children. We are left now with a home me and the children are on edge to be in no where to put are stuff I just don't know what to do and all I have had is a sorry it never should of happened from the Healthvisiter but it just doesn't seem to help with the circumstances we have been left with.

I have been cited for a road traffic offence and recieved my trial date papers in the post however in the same envelope there was another persons paperwork which details their name, address, date of birth and the offence labelled against them and trial date. A clear breach of data protection by the courts. I am worried that my details may also have been sent out this person or another.

My brother which has mental health problems, was phoned by a nhs practice. asking him to attend an appointment, which he refused. They then informed him that I his sister had concerns about his mental well being. knowing full well he has violent tendencies, I'm now left scared and unsure of what to do? Received a letter from bank, declining me for account upgrade (i had applied), but the third page of the letter was the print off of an application made online, this wasnt my application, but another female, her account details, bank funding methods, name, everything! but no sign of mine!!!!! Hi, My local council keeps phoning my parents and telling them that i am late on sons transport payment and telling them how much it is and also telling them that my son will have to change schools if i do not pay. I moved in with my parents for a week about a year ago hence they have there number. I have asked them to delete there number and phone my mobile and not to talk to my elderly parents. They have now done this six times over the past year (every time a payment is due, which i do pay) and six times i have told them to stop!!!

@ESN. Write to them requesting an immediate refund and also pointing out that your personal details have been compromised. Most of the well known supermarkets have very efficient refund policies so this is quite surprising to hear. Do they have a social media channel? Sometimes this is a great way to get a reaction when customer services is being slow (if you're desperate). Really you should be given some kind of compensation as a good will gesture, on top of the refund. If we knew which store it was we'd be able to tell you what the refund/compensation policy was. Trading Standards should be your next point of contact if all else fails.

I recently ordered my groceries online with a well known supermarket chain and the order failed to arrive within the specified delivery time. I didnt think much of this as I understood that many things could have caused the delivery to be late, however, after half an hour I contacted the supermarkets customer service department to inquire as to as to the location of my order. I was advised at the time that the customer service lady would contact the store directly and get them to contact the driver, who would then in turn contact me to explain why he was late. This was fine, however two hours after the end of the designated delivery time my order still hadnt arrived, so I called the customer service number again and received the same response.

Two days passed and I still had not received my order, despite having contacted the customer service team again and being assured once again that they were very sorry for the delay and that they would contact the store who should be in contact with me very shortly. I had come to the conclusion that there must have been some technical error and I wouldnt be receiving my shopping, however that night I received a call from a man who lived at the other side of the city to me, saying that he had received my order mixed in with his, and he was able to contact me because in addition to receiving my food order he also received my order form, which provided him with my personal details, including my full name, full address and contact number.

He told me that he had contacted the customer service team to inform them of what had happened and filed a complaint with them, he then asked if they had been in contact with me as they had informed him they would call me immediately. I told him that they had not and decided to ring them again myself to make a formal complaint, once again the staff apologized and told me that I would hear something soon. This was four days ago and I still havent heard back from the supermarket, and I have since been charged for an order I did not receive.

I'm just wondering what advise you would give me as to what to do next? I cant seem to get them to contact me back, and I cant help but thinking that if they'd responded to my complaint when I originally told them my order was missing, it wouldnt have found its self worked in with my personal details within another customers order, which wasnt due to be delivered for two days after mine anyway?

I requested all information held about myself from my local council under the Freedom of Information Act as I am currently disputing an overpayment. I received the bundle last week and within it along with my documents were several other council residents details including addresses, pictures of their homes, details of their children and cases. This is clearly a breach of data protection but I am not sure what to do about it as I'm now concerned that my details may have gone to other people in the same way.

What about if you local council gives out you address well sent it to the ex husband. When on my account there two flags in red "do not disclose address to the mr. Ms has a restraining order on for Domestic violence " yet they sent a copy of council tax to his address with my new one. Were do i stand. My ex gf bought a car paid half and entered a hp agreement with barclays

In jan 2014 we provided my car n her car as px against x1 car at the same garage my gf bought hers.

We returned this purchase within cool off period after x3 failed attempts to terminate this agreement. Police were called and contracts terminated. They even threatened us with there solicitors were looking into the agreement and receiving threating phone calls at 2am

The car finance provider returned to barclays from satander.

When visiting another car sales place we were unable to obtain a settlement figure. My gf details failed security with barclays. The garage called them back and tried my address and her name. This passed security and a figure was obtained.

Therefore barclays have changed a loan to my address details when i entered no financial agreements with anyone, or provided anyone with this information. Why did barclays change this. The only reason i can think of is that the garage had my v5 and passed this information to barclays for????

We also found a completed agreement in the car we returned on test driving. We handed this back to them.

Ive informed barclays and i just obtained generic complaints responce, unable to help and to contact FOS.

FOS advised ICO so i informed these and OFT and Barclays final response for this complaint.

Due to dealing with this garage, the distress i encountered was unreal. I dont want to go into too much detail but i was hospitalised twice and lost approx 6 months work.

No one would listen to me at the time at thought i was going crazy

Therefore barclays should be able to prove data protection breach on their own systems. I did not obtain any finance with barclays or satander or give the garage my details expect my V5.

Why has barclays got my information on their systems.

Do i have a case regarding distress damages. Should i envolve a solicitor?.

Barclays no longer offer finance at this garage anymore

@NNK> Sorry it's not clear who the employer shared his information with? If you've already commenced a claim, they should be advising you as to whether it's worth proceeding with.

Hi,

my husband has applied for an injury compensation claim and it turned up that his employer shared more information from his medical records that they should; totally irrelevant illness that could cost my husband's position and reputation.

Shall we proceed on court?

@loggiebear. Hopefully the ombudsman will be able to sort this out for you and if you are entitled to any compensation as a result, the ombudsman report would help you. If i were you, however, I'd change my bank account to another provider.

Hi somebody please tell me where I stand, I have changed my address with my bank (lloyds) more than 5 times now as well as my phone number. They keep however, sending my bank statements and letters to another address and text messages including online banking passwords to another number. I have now raised 2 complains with my branch manager and continue to regularly change my address,the ombudsman is now aware and I have to wait until some time next week to expect a phone call from lloyds. I left my previous address over a year ago? What rights do I have and where do I stand please?

@albo. As the article says, it would be up to you to prove that you underwent "damage, or damage and distress" if you wanted to claim under the Data Protection provisions in court. You could give it a try but would financial compensation really help? This has of course happened to many other people before. You might get a more successful (and less stressful) outcome by writing to the company's head office expressing your concerns and the effect it has had on you/your family.

hi, a large photo processing store store accidentally gave our photos to another person, the photos contained naked pictures of my 3 year old in the garden and photos of my nine month pregnant wife in just bra and pants..
the photos also contained my wifes name and phone number and we only realised it had happened when my wife recieved a call from the man who was given the photos by mistake.. would this be eligible for a claim? they offered the photos for free but we said that wasnt really good enough as it is a pretty serious error

Hi I have a case against the nhs for breach of sction 13 of the data protection act. It has caused mental health issues and loss of earnings. They have admitted there mistake but I cant afford a solicitor to even write a real complaint letter asking for compensation. Citizens advice said write it yourself, legal aid doesn't cover it and I cant seem to find a no win no fee company that covers data protection act breach. Can anyone help?

Hi, I have had an ongoing complaint against the local authority social services department
who have lost sensitive data regarding myself and my daughter which they cannot recover, Also i had a recent severe health matter which i had informed them in writing i did not want disclosed to my daughter. this information was passed onto a third party who then told my daughter. I suffer with mental health problems and the hurt and distress this caused me including a breakdown in my relationship with my daughter because of this caused me to start self harming again which i had not done for many years. The council has done an investigation into my complaint and and found there were 17 sensitive contact notes lost which they cannot recover and also that the employee did disclose the information about my health. There is also a 3rd matter which their investigation did not find evidence of. can i claim compensation from the local authority for the loss of data and the breach of trust and how would i go about it. hope someone can help. my nephew has autism I live in the uk. He has a council flat assigned him but he finds it disturbs him being too close to relatives. An application for a move made to council. They have passed his info to a THIRD PARTY. called MINOS PERDIOS. They council past his file which includes personal data,his medical information and diagnosis report and details about his work and earnings. I feel his medical info is private and that they had no right to pass this on. There response was that my nephew signed a piece of paper giving permission, but this was only for them to COLLECT info not to DISTRIBUTE it. I feel this is a breach of his rights. He is a vulnerable man living alone with mental issues and I am angered that they are allowed to do this. Perdios are now asking for personal info about his family..........we feel this is wrong........and will have no choice but to forget the whole thing. How do you feel about this, am I am being unreasonable?

i work for a local authority as a compliance officer. I am running a criminal case against a mental health patient who has been violent to me and made threats with knives, guns and rape to females in other organisations.
His housing trust are running a parallel civil eviction case and have asked me for evidence of my involvement. I provided details to them, which they have disclosed to the other party - including my full name, date of birth, home address, home telephone number, workplace and employment number. They have accepted that it is a serious breach of data protection and has placed me and my family at considerable risk.

Does this qualify as 'damage and distress'? There are still cases pending against this individual for which I am either the prosecuting officer or the main witness. He will have plenty of motive to harm me, my family or my home if things do not go his way.

I have taken great care over the years to cover my identity and personal information - this has all been undone by a careless disclosure.

I would welcome your advice, and representation if required.

i have been in dispute with Link Financial about wrong default notices listed on my Call credit score for the period of 4 months in 2006 and 2007.
They have now removed them but i had asked for compensation since this had dramatically effected my credit score for just over 4 years.
they came back to me but did not acknowledge that this was there fault but offered £150.00 for stress and inconvenience. I was happy that the wrong defaults were removed and from information from Call credit only Link Financial can change the rating.
Link Financial were unable to provide an answer as to why the default reappeared for these months.
So to clarify that after speaking with Call Credit the fault lies with Link Finance as only Link Finance can add or remove these reports using Call Credit.
i refused the £150.00
and said i would be looking at going to a small claims court as i felt this was not enough compensation for 4 years of mistakes of there doing.
I have all correspondence from me to them and vicer versa but do not have proof of declined credit applications except one from my bank that were made due to my poor credit rating.
do you think i have a case?
any help and advice would be appreciated

My Building Society firstly lost my P60 & wage slip which I sent to them for a mortgage application, I complained by email about the loss of my documentation and was informed on Friday that they had sent my P60 which contains my salery, address, working address and National insurance number & wage slip on to another customer which they are now awaiting its return? they have agrred to pay £20 subscription for ID protection for the year and offered me a bottle of wine does this seem reasonable as I am concerned going forward how this is going to effect me?

I would like to know if having passed mine and my husbands personal and our businesses information to an agent to raise funds it breaks the data protection act if he passes these details to another agent (not a finance source). This was done without any permission from ourselves or prior notification. In response to our complaint from ourselves he has responded by removing himself from our emply. Please advise if we can complain and if possible claim some compensation as this has caused financial problems as we could have gone elsewhere as far back as 2 to 3 months ago. many thanks Pat Adlam
